An English-Chinese Translation Of Grand Juror’s Handbook And Analysis Of The Translation

The jury system plays an important part in the American judicial system.Grand Juror’s Handbook introduces grand juries and grand jury service in detail.An English-Chinese translation of this handbook will help people have a better understanding of the grand jury system.This thesis is to analyze the difficulties appearing during the translation process,and pick out some examples translated with different translating skills.Firstly,there is a specific translating principle in the translation of legal texts,which is the criterion for this translation practice and of great significance to improving the quality of the translation.Secondly,as to the translation of legal terms,especially those also with common meanings,before translation we should work to distinguish the common meaning and legal meaning of these words.The legal meanings of the words should be translated in the target language.Thirdly,in terms of sentence translation,the techniques of addition and conversion can be used according to the sentences’meanings.The translation of passive sentences and long sentences are emphasized in this thesis.The passive sentences in legal English can be translated into passive sentences and active sentences in Chinese.The long sentences can be linearly translated or divided,or the word order can be adjusted.Lastly,after this translating practice,the author realizes that the translation of legal texts not only needs translating skills but also requires mastery of the legal knowledge.After that with all kinds of translating skills we can produce a good translation.So it is required that the translator should have a good command of both languages and better usage of all sorts of translating skills.After a thorough understanding of the original text,the translator should also read lots of books about the jury system."Jury"and"juror"have been popularly translated as"陪审团/陪审"and"陪审员"which are,however,mistranslations according to the study by Professor Hu Zhaoyun.This thesis agrees to and adopts the new translations "决认团/决认"and"决认员"initiated by Hu Zhaoyun,and also adopts a series of other related translations initiated or advocated by Hu Zhaoyun and others.The author hopes that the translation of the Grand Juror’s Handbook can help the readers understand the jury system and also provide a reference for China’s.judicial reform.
