Professional Ethics And National Law

Emile Durkheim(1858-1917),one of the three founders of sociology,devoted his life to the reconstruction of social order.Facing the division of labor in modern society,Durkheim is different from economists who only see the economic function of division of labor.On the basis of profound analysis of the social roots of division of labor,he puts forward the social function of division of labor,that is,promotes social unity.It is believed that social order can be integrated only through the interaction of groups and countries.In modern society,occupation has become the basic attribute and main activity area of the individual.As a sub-group of the society,the professional group has become the link between the individual and the country,cultivating the civic morality and carrying the national law upward.Standardizing the professional ethics of professional groups,fostering the spirit of solidarity and mutual assistance among members,and curbing the infinite expansion of individualism.Although professional groups play a huge role in promoting social solidarity,they also have their own limitations.Professional groups may form a suppression of individuals,and professional ethics can only affect specific professional life.Durkheim saw this and made in-depth thinking.On this basis,the state and the law were proposed.The state supervised and restrained the professional groups,prevented the group from suppressing individuals,and the law established the basic activities of the professional groups.Finally,through the joint action of professional ethics and national law,the organic unity of modern society is realized.This paper analyzes Durkheim's thought of social solidarity from the perspective of professional ethics and national law.This paper is divided into four parts to study this issue:In the introduction part,firstly,the research value of Durkheim's social unity thought is expounded,then the current domestic and international related research is reviewed,and the specific ideas and methods for studying the problem are finally explained.The first part is the interpretation of the theory of social solidarity.It reveals the social background and ideological origins of Durkheim's social solidarity theory,and specifically expounds the influence of Tennis' s division of "community" and "society",and the birth of Durkheim's theory of social solidarity.The second part,the professional group,the form of social solidarity.Explain why the form of social solidarity is a professional group,explore the developmental changes of professional groups in the Durkheim doctrine with the evolution of society,and the integration of social solidarity in modern society.The third part is the content of professional ethics and social solidarity.Specifically discuss the role of professional ethics in modern society: the shaping of modern economic life patterns;the coordination of individual interests and collective interests;the reshaping of social structure.However,due to the limited nature of professional ethics in rebuilding social order,Durkheim introduced the state and the law.The fourth part is the national law and the foundation of social solidarity.In the construction of Durkheim's reconstruction of modern social order,the law is also an indispensable part of social integration.As a country that enacts laws,it is above professional groups and can prevent professional groups from suppressing individuals.The law stipulates professional groups.The principle of basic activities has become the guarantee of freedom in modern society.Ultimately,through the interaction of groups and countries,professional ethics and law,social progress and unity are achieved.Durkheim's idea of social solidarity,while finding a way out for the reconstruction of order in modern society,also led to criticism and criticism.It is in the process of criticism and reflection that we have seen the contemporary significance of social solidarity.It is of great significance for realizing social integration,rebuilding social order and promoting social solidarity in today's social changes.
