The Study On Chinese Contract Of Economic In Dunhuang During The Guiyi Army Period

During the Tang and Five Dynasties and the early Song Dynasty,the Chinese economic contract in Guiyi Army period is the typical representative of the contract,which inherited the contracts of the Han,Wei,and the Northern and Southern Dynasties,and was followed by the Yuan,Ming and Qing Dynasties.Based on the contract forms,this paper discusses the format and content of four types of economic contracts in the period of Guiyi Army,such as business bonds,loan bonds,hire bonds and lease contracts,and summarizes the overall status of contract development in this period.Based on the discussion of the form,this paper takes four kinds of contracts as a whole and studies the social phenomena behind the clauses by analyzing the terms such as the time,the reasons,the parties,the breach of contract and the guarantee at the end of the contract.Then,the paper focuses on the principles of contract formation,characteristics and social system reflected in the contract in this period.And discusses the application of private contract and laws,mutual agreement,integrity and other principles in the contract.Also,this paper analyzes the impact of Buddhism,national laws and regulations on the contract,and discusses the origin of the law of neighbors and the system of pardon and its performance during the period of Guiyi Army.In a word,the Chinese economic contract during the Guiyi Army period is an important part of the development history of ancient Chinese contract,and it reflects the social and economic status of the Dunhuang folk during the Guiyi Army period.It also reflected the level of political culture at that time.
