Research On Contract Mechanism In Government Purchases Of Public Service

With the development of the new public management movement,the contractual practice of government's purchase public service has been accelerated.The contract mechanism in government purchases of public service has good social effects and economic advantages to make up for the disadvantages of the traditional public services' supply mode,which is inefficient and lack of response to consumers.The contract mechanism improves the efficiency and quality of public services supply.And through the introduction of mechanisms,the public services' supply becomes more vibrant.However,at present,there are few domestic existing researches on this topic,which are not enough to guide the rapid development of the contractual practice of government's purchase public service.This paper takes the contract mechanism in government purchases of public service as the research object.And based on domestic and foreign researches,this paper constructs a practical framework of the contract mechanism in the process of public services' purchase,which draws lessons from the theory of contract process and the theory of mechanism design.The practical framework analyzes the core issues of government purchases of public service that need to be addressed in the stage of contract concluding,executing,monitoring and terminating or changing,then explores how the mechanism design can be carried out at each stage to ensure the validity of the operation of the public service purchase contract.This practice framework is used to examine the contract practice of J district community service center project in SH city.From this case,the actual operation of the contract mechanism in public services' purchase is summarized to further optimize the contract mechanism in public service purchase.Finally,on the basis of empirical test,this paper further explores the necessary improvements of the practical framework of contract mechanism in public services' purchase.This paper constructs the practice framework of the contract mechanism in the process of public services' purchase,and carries it on the empirical test.Firstly,it points out that we need to emphasize the establishment of the legal guarantee mechanism,the market competition mechanism and the contract review mechanism in the contract concluding stage.Secondly,we need also emphasize the combination of incentive mechanism,breach of contract correction mechanism and credit evaluation mechanism in the contract executing stage.Thirdly,in the contract monitoring stage,it is necessary to promote the combination of evaluation and supervision mechanism,incentive mechanism and information disclosure mechanism.Fourthly,in the contract terminating or changing stage,we should establish a summarizing and learning mechanism within the governments.The main innovation of this paper is to construct a practical framework for the operation of the contract mechanism in the purchase of public services.The process of "contract concluding-contract executing-contract monitoring-contract terminating or changing" in public services' purchase is investigated and examined by the case in order to further improve the framework design.This study provides a new perspective for understanding the contract mechanism in public services' purchase,which is conducive to guiding the contractual practice of public service purchase in China and also has a great theoretical significance to promote the researches of the transformation of government functions,public service supply and service-oriented government construction.
