The Research Of China's Customs Protection Of Intellectual Property Rights

Since the mid-20th century,international trade and economic exchanges have become increasingly frequent,in which a large number of international trade infringement of intellectual property rights,this phenomenon has drawn international attention,because Customs protection of intellectual property rights in the fight against infringement of goods can play an important role,there is more and more research on Customs protection of intellectual property rights,and also reflects more and more perspectives.Intellectual property,as a kind of intangible property rights,is more complex than general property rights,and the conflicts of interest are more intense.The benefits of intellectual property rights in Customs protection are reflected in the interests of social public interests,national interests,the interests of intellectual property rights holders,the interests of consignee and consignor and other interests of intertwined,often conflicts of interests can not be reconciled,so the conflicts must be handled in an interest balance approach.Since the promulgation of the first"Regulations on Customs Protection of Intellectual Property Rights" in China,several revisions experienced during the period also fully reflect the purpose of balancing the interests of all parties.As the history of China's Customs protection of intellectual property rights is not long,now the reality of China's society has not yet reached the perfect fit,we need to further examine from the perspective of interest balance,making it an important tool to meet China's national conditions and promote China's economic development.In this paper,the author tries to discuss Customs protection regulations and cases which are exposed to the Customs work in the view of interest balance,and use the methods of theoretical analysis,case analysis and comparative analysis to discuss the following aspects:First,the basic situation of Customs protection system of intellectual property rights,through the development of the current system,the main content and characteristics of a brief introduction to state and expound the connotation of interest balance of our country's Customs protection system of intellectual property;Second,analyze some of the key issues of interest imbalance in China's Customs protection system of intellectual property rights;third is the international IPR Customs protection system to be investigated in order to get useful inspiration;Fourth,present a method to balance the interests of the parties on the basis of the previous discussions.
