Labor relation is an important part of production relation.In the process of the old and new system,labor relations are facing an unprecedented impact,labor disputes have continued to rise in the case of the trend.The party's eighteen marjor clearly put forward the construction of harmonious labor relations.China's "13th Five-Year" plan outline pointed out:"We will establish coordination mechanism of labor relations,strengthen labor security supervision and dispute mediation and arbitration,safeguard the legitimate rights and interests of workers,protect the rights and interests of workers in informal employment,manage the problem of peasant workers wages owed,in order to establish harmonious labor relationships."Under the new historical conditions,building a harmonious labor relationship with Chinese characteristics is an important part of strengthening and innovating social governance,ensuring and improving people's livelihood,and also the necessary requirement of carrying out the new concept of development.Around the world,as a coordination mechanism for labor relations,the system of collective negotiation and collective contract have become the maintenance of legitimate rights and interests of workers,promoting the balanced development of labor relations in a common and important institutional arrangements.As the cluster organization of the party,trade unions play an important role of protecting the lawful rights and interests of workers and maintaining social harmony and stability.Equal consultation collective contract system is the most basic legal system of market economy country to adjust labor relations,and it is an important management system arrangement for carrying out the idea of shared development.Deepen reform to promote the system of governance and management as the goal,in this background,a sound legal system of collective contract,further play the role and functionof trade union incollective contract negotiation is particularil important.Shenzhen is the first area of market economy reform,research on Shenzhen Trade Unions in collective bargaining result and problem exposed,other city in our country has very realistic and instructive reference.According to the trade union work practice in Shenzhen,divided into six parts to study the collective contract negotiations in trade unions.In the first part,it introduces the research questions,the significance of the topic and the research methods,and defines the core concepts;The second part,combing the collective contract negotiation system in China's historical changes and development process of China's trade unions;The third part,combined with practice situation in Shenzhen,in current labor market relations,complex,globalization,as the sole legitimate representative of workers,explore the function structure of trade union in the collective contract negotiation;In the fourth part,this paper expounds the performance forms and main reasons of the absence of trade union performance of functions above;the fifth part,on how to promote the transformation of the trade union function in the collective contract negotiations,puts forward the reform path and countermeasures,etc;the six part,the conclusion of the study.
