Dilemma In Bribing Punishment And Solutions

Since 18th CPC National Congress,anti-corruption thoughts of insisting on cracking down on both high-ranking "tigers" and low-level“flies" has restrained spreading corruption tendency effectively and formed atmosphere of“dare not to be corrupt" in society.Anti-corruption has achieved certain results.Reviewing these corruption cases of sacked officials,it is really shocking to see such high-rank officials and such large-sum money involved.Bribery,as most common corruption form,is priority among priorities against corruption in our country.Bribing,as the source of bribery,is the soil of bribe-taking.It is unfavorable to social stability,as it violates state functionary probity,destroys social fair competition rules and disturbs regular social economic orders.Our country is intensifying efforts on cracking down on bribing all the time.Introduction of Amendment(IX)to the Criminal Law has brought fight against bribing to a new level and shown country's confidence and determination in severely punishing bribing.However,as prosecuting staff,we should rationally recognize that bribing is becoming more and more common in nowadays when social economy is developing rapidly.There is still a long way for us to go on bribing punishment.Compared with bribe-taking,bribing is somehow neglected not only in theoretical research but also in judicial practice.There is not much special theoretical work.It is incidentally mentioned when talking about the bribe-taking.This essay introduces dilemma judicial authorities face in bribing investigation and case handling as well as the causing reasons in perspective of judicial authorities work,rethink over disadvantage of existing policies,put forward effective countermeasures to overcome difficulty in bribing punishment both in legislation and judiciary.Hope it will stimulate judicial research staff to think over empirical-analysis of bribing,improve theoretical and practical research continuously,provide forceful theoretical support and practical experience for judicial authorities and punish bribing effectively.
