On Information Disclosure Of Procuratorial Organs

The disclosure of case information is the most important and the core of the disclosure,but in practice,the procuratorial organs always had the problem of avoiding the important and dwell the trivial,and rarely disclose the case information.The Supreme People's Procuratorate in October 2014 issued The People's Procuratorate Case Information Disclosure Requirements(Trial),transfer the focus of the disclosure to the case itself,it is no exaggeration to say that this is not only China's procuratorial information disclosure milestone,but also the milestone in the issue of judicial transparency in our country.The Decision of The Central Committee of the Communist Party of China(CPC)on the major issues of comprehensively promoting the rule of law by the Fourth Plenary Session of the Eighteenth Central Committee proposed to build an open,dynamic,transparent and convenient sunshine judicial mechanism to escort the information from the prosecution at the political level,greatly promoted the development of case information disclosure system.Information disclosure system is the requirement of the people's sovereignty principle,with a profound historical evolution and origin.This paper is based on the theoretical basis of the information disclosure system of procuratorial organs,analyzed the development of the system and investigated the cases information disclosure of some procuratorates since the implementation of The Provisions on the Information Disclosure of Cases of People 's Procuratorates(Trial).Based on the analysis of the research data and the predecessors' academic achievements,the author thinks that there are some problems in the system design and related supporting mechanism of the procuratorial office in our country.In view of these shortcomings,the author summarizes the experience of the past,draws lessons from foreign experience and on the basis of responding to the most concerned issue of people positively to put forward the improving proposal: To establish The Information Disclosure Law;Set the prosecution case information disclosure quality review system,assessment and accountability system,relief system;to develop The Personal Privacy Law and other relevant laws;Set the opinion collecting system to improve the validity of the contents of public information which published by the procuratorial organs,and improve the construction of the information disclosure platform of the procuratorial organs.
