Study On The Legal System Of Ecological Compensation In China

Nowadays,economic leap type development has brought a series of environmental problems,including forest area is shrinking,lakes and rivers runoff decreases,and by different degrees of water pollution;Part of the people for their own health,and the pursuit of a better life,for life in a better environment,this rising from the whole society to protect the environment of the faith,but to protect the environment,is bound to sacrifice part of the interests of the people,cause social imbalance of public environmental interests,so,we put forward the compensation for ecological protection,to compensate for the loss of interest.Since ecological compensation is put forward,times have changed,for nearly 30 years,from the initial development of environmental science study to research in the field of social science,the scholars of our country through positive innovation,and the ecological compensation system to promote the legislation construction,and eventually settle in the new revision of the environmental protection law.But we also need to develop a more detailed rules to ensure practical application of compensation for ecological protection smoothly in the future.This article is divided into six parts altogether,the first part introduces the concept of ecological compensation,start from the text,and introducing practice field,finally put forward his new explanation of the concept of the ecological compensation legal system;The second part introduces the ecological compensation legal system should be established by the basic principles of what is,because,in the study,there are many wrong idea,this article,the author analyzed and demonstrated;The third part,is to discuss what are the subject of compensation for ecological protection,respectively;The fourth part the author analyses the ecological compensation legal system should have the value orientation,with the right value guidance,can we develop smoothly compensation practices;The fifth part the author analyzes the ecological compensation work at what are the obstacles faced,alignment with obstacles,to solve it,The sixth part,the author introduced the experience of compensation for ecological protection of the United States and Germany;The seventh part,the author carry out the work of ecological compensation in China,put forward Suggestions to improve it.Hope that our country's ecological compensation legal system can improve as soon as possible.
