The Interest Game And Balancing In Local Legislation

The essence of law is distribution and adjustment of interests.The ultimate goal of law is to achieve the relative balance of the whole people's interests.With the reform and development of economy and society,the patterns of social stratification and interest diversification have gradually emerged,and local legislation has become the last barrier to balance and protect various interests.As a mechanism of benefit expression and balancing,interest game has a great impact on local legislation.In this research topic,the influence of different benefit factors on legislative activities and decision-making was discussed,based on the specific practice of local legislation in Suzhou.Then appropriate game mechanism and legislative coordination mechanism could be introduced so that relative balance of interest distribution could be realized during the conflict of different interest subjects.The quality of legislation and legislative system could also be improved.In this thesis,the basic connotation of local legislation and interest game was analyzed so as to demonstrate the objectivity and necessity of the existence of interest game in the legislative process,firstly.Then the game phenomena during the local legislation process caused by legislative authority bondage,right opposition and conflict as well as inclination to departmental benefit were studied based on the legislation practice for five main benefit game subjects,respectively.The negative impact of interest game on local legislation benefit and the current limitation of local legislation interest coordination were analyzed.It was advised that local legislative mechanism should be improved so that the principle of coordination could be clear.The improved system design of various interest expression and coordination during legislation process of local legislature from every legislation link of drafting,scrutiny,voting and feedback was also proposed.
