| The reformation of Procuratorial Quota system,as an important part of the personnel system reform in our country,is not only the top priority for the judicial system reform,but also the key to realize the professionalization of the prosecutor and the real implementation of the judicial responsibility system.At present,the reformationofProcuratorial Quotasystem has been experienced from the pilot stage to the full roll-out operation stage,and the contradictions and problems in the reform have been further highlighted.Besides,the historical problems of the pilot reform still restricts the effective implementation and long-term development of reform.In this context,the author chooses two typical procuratorate samples of F province to analysis the questions and make some suggestions.Based on the empirical research and interview investigation,the author collected and integrated a series of relevant data of the procuratorate samples to analyze the problems faced by the procuratorate samples in the process of reform and implementation,and puts forward some pertinence and operability suggestions.This paper will provide some positive guidance and references in the reformationofProcuratorial Quotasystem for other provinces and cities.This paper includes mainly four parts,and the first part discusses the specific connotation of the Procuratorial Quotasystem and the theoretical and practice foundation.Based on the practical basis,the significance value of the reform is explained,which is to promote the reform of the public procurator’s management,to provide professional security for the prosecutor’s team,and to dilute the administrative color of the prosecutor and to modernize the judicial organization.The second part is an empirical study of the reform and operation of the Procuratorial Quotasystem.In this part,the typical city of L and the primary hospital of Y city in L city district in F province are selected as the samples.The overall operation situation of the reform is summarized in three aspects:the scope of the Procuratorial Quota,the construction of the case organization,and the source of the power of the procurator.The new mechanism of procuratorial power,such as the case management mechanism and the approval process,the head handling cases,the joint meeting system,and the prosecutor assessment machine,is investigated and studied.Relying on the data analysis of the procuratorate,the third part points out the specific problems of the reform of theProcuratorial Quota system.The problems mainly include the lack of scientific selection criteria and selection criteria.Furthermore,the procedures still need to be perfected,the new type of internal organs and the construction of the case organization are slow,the devolution of power is not complete,and the cases are less contradictory.The fourth part puts forward corresponding countermeasures and suggestions for the above-mentioned problems.Specifically,we will improve the selection criteria of public procurators,standardize selection procedures,optimize the classification management of procurators,and accelerate the construction of new models. |
