According to the Constitution,the procuratorial organs are the legal supervisory organs of our country,exercising the legal supervision functions,in a unique and functional position.It's been nearly 30 years of theoretical discussion,institution construction and pilot exploration of the the Procuratorial personnel classification management reform.In July 2016,the central government of our country started the reform of the judicial system,of which personnel classification management is the basic and extremely important part.According to the deployment of the Central Political and Legal Conference on January 12,2017,the task of reforming the classification of prosecutors should be basically completed within 2017.Before the Personnel classification management reform is started,the procuratorial personnel had been managed according to the administrative rank,which caused fuzziness of the judicial attribute,the thick administrative color and the serious influence on the function of legal supervision.The reason why the procuratorial classification management reform is carried out is to strengthen the judicial properties of the procuratorial organs,to dilute the original administrative colors,to build a more scientific and efficient mechanism for procuratorial power,and to promote the regularization,specialization and professionalization of the procuratorial team.Studying the issues related to the classification management reform of the Procuratorial personnel has important theoretical and practical significance.From a theoretical point of view,the theory related to the reform of personnel classification management has undergone discussions for nearly two decades.This paper analyzes the related problems of reform in light of the specific cases of personnel classification management reform and has reference value in the existing theoretical analysis and supplement.From a practical point of view,this paper discusses the gains and losses in the reform of the personnel classification management and provides an excellent starting point for the next step in improving the classification management of prosecutors.It has very important practical significance.On the basis of literature research and empirical analysis,this paper uses the research perspective of the whole analysis,using the literature research method,comparative analysis method and case study method,taking the reform practice of the classified management of prosecutors in the H city as an example,and revolves "why must reform" and " analysis of current reform " and "how to push the next step".This paper analyzes and studies some problems that have appeared or may appear in the reform of the classification management of procuratorial personnel,and tries to put forward some countermeasures and suggestions to improve the classification management system of procuratorial personnel."Why must reform" includes introduction and the first chapter:Introduction from the definition of procuratorial staff,procuratorial classification of the two concepts define the scope of the start,introduces the theoretical basis of this paper,research framework and research methods;the first chapter,discusses the classification of personnel management Pre-reform procuratorial organs of the traditional management of malpractices,clarification of the classification of procuratorial personnel management reform of the two important values to prove the classification of procuratorial management of the need for reform,indicating "why must reform",then describe the procuratorial classification management reform is relatively long Of the progress of the implementation of procuratorial classification management reform shows the existing theoretical and practical preparation,indicating "ready for reform".Finally,discuss "how to reform" through the classification management to bring the core changes in personnel classification reform."The current reform analysis" includes the first 2-4 chapters:the second chapter discusses the historical evolution of the classification of procuratorial personnel in our country,expounds the main contents of procuratorial system in different periods of our country and its mission in a specific historical period;then discusses The third chapter,taking H city as an example,deeply analyzes the practice of reform from the classification of prosecutors to the present H City and the reform results obtained.The fourth chapter analyzes the case through H city Procurator classification management reform problems,and trying to analyze the reasons behind."How to proceed in the next step"includes the fifth chapter,which discusses the six aspects that should be perfected in the reform of the classified management of procuratorial personnel so as to provide reference for the next reform of personnel classification management.Through the study,this paper holds that the reform of the classified management of procurators in China has raised the threshold of the procurator's tenure,gave the prosecutor a greater power and improved the efficiency of the case,but there are still some problems:"lack of prosecutor "problem is still outstanding,the difference of salary and treatment is easy to contuse the enthusiasm of the staff,the administrative work has entered the dilemma,the serious brain drain,the main and auxiliary mode of handling the case brings unavoidable deadlock,the lack of scientific and operational prosecutors performance evaluation mechanism and the professional quality of procurators need to be improved.According to that,this article puts forward six improvement measures:first one,establish a dynamic post management mechanism.Second one,continue to improve the list of powers and establish a responsibility system for handling cases.Third one,establish a scientific and reasonable post evaluation mechanism by clearly assessing the standards and enriching the assessment methods.Fourth one,improve the internal and external supervision mechanism synchronously,and promote the establishment of a multi-level and omnidirectional procuratorial power supervision mechanism.Fifth one,protect the prosecutors' salaries and income levels effectively,improve the system of judicial liability immunity,and improve the professional guarantee mechanism that suits the professional needs.Sixth one,carry out the reform of provincial management of personnel,finance and property,interrupt the procuratorial organs' dependence on local governments,and safeguard the relative independence of procuratorial organs.
