The Research On The Legal Predicament And Countermeasures Of Villagers' Autonomy

As a grass-roots mass autonomy system,the system of villager autonomy in China has developed for nearly thirty years,and the history of these thirty years is one of the three development stages of the rural grass-roots governance system in China.Before that,China's rural grassroots governance mode has gone through two periods:the system of village and township(administrative villages)and the combination of politics and society.Since the reform and opening up,the state has gradually tried to retreat behind the curtain for flexible management and support,rebuild the power of the rural autonomy and make it go to the front desk of the rural social governance,and form the governance pattern of the cooperation between the government and the villagers' autonomy,and gradually formed the "township government village governance" model with the villagers' autonomy as the main content.The implementation of villager autonomy system has realized the creative transformation of rural grassroots governance system.The state establishes and improves policies and regulations concerning agriculture,and promotes the continuous development of the villagers'autonomy system.However,because of the lack of self-organizing ability of farmers,the confusion of the relationship between the main body of rural governance,the peasants' rights can not be fully realized,the villagers' autonomy system is lack of operational supporting system and other factors,the system of villagers' autonomy in our country is still greatly improved.Therefore,in order to realize the overall revitalization of the rural society and create a new situation of building a shared governance and sharing the whole nation,it is of great significance to improve and develop the villagers' autonomy system.In order to improve and develop the system of villager autonomy,on the one hand,through legislation to improve the system of villagers' autonomy and operating mechanism,further straighten out the relationship between the villagers committee and the Party branch,straighten out the standard documents of the "three rural" issues and improve the design of the supervision mechanism of the villagers' autonomy.On the other hand,to promote the effective implementation of the legal norms of agriculture related,the construction of the rule of law township government and the construction of the Legal Affairs Council,so as to realize the rule of law and actual effect of the rural grass-roots governance.This paper mainly focuses on the legal dilemma and Countermeasures of villager autonomy,which is mainly divided into three parts.The first part is an overview of the status of villagers' autonomy.This part mainly introduces the evolution process of villager autonomy system,involving the legal norms of villager autonomy,the basic situation and problems of villager autonomy.From the three aspects of history,system and problem,we comb and explain the villager autonomy system.The second part is the legal dilemma of the villagers' autonomy system.This section mainly analyzes the basic status,problems and causes of economic rights and institutional aspects from the perspective of democracy and political rights.From the outside to the inside,we should point out the villager autonomy system from the superficial to the deep.The focus of the legal dilemma is the relationship between the rule of law and the rural grass-roots governance logic.The third part is the countermeasures to improve the villagers' autonomy system.This section elaborates on the improvement of legislation and the effectiveness of villagers'autonomy,mainly around the rationalization of the legal relationship between the management subjects and the implementation of laws related to agriculture.
