Research On The Protection Of Left-behind Children In Rural Areas In China

Child development relationship of family happiness and social stability,the influence of urban and rural dual structure and urbanization process accelerated,many young adults born in the countryside flock to the city,into the city and then can't and the urban population to enjoy the same housing,residence,education policy and system,and the city migrant workers income relative to the urban population is relatively low,as a result,many migrant workers in the city of rural registered permanent residence staff have to keep their children in rural life,producing a large amount of rural left-behind children.In this paper,the author divided into three parts,the first part,starting from the general situation of left-behind children in rural areas in China,defines the scope of left-behind children in rural areas in China,and because lack of custody after cause analysis practice problems of rural left-behind children and lead to the lack of custody.The second part analyzes our country rural left-behind children's rights and interests protection law problems,mainly from the aspects of rural left-behind children custody security,security,criminal law on rural left-behind children,tort law protection,the right to education security inefficiency of legislation.The third part from the protection of rights and interests of rural left-behind children should stick to the children's interests maximization principle,fair principle,the principle of combining punishment with education,respect participation principle,proposed legal protection of rights and interests of rural left-behind children in China,mainly from the perfect our country rural left-behind children's rights and interests protection legislation,which improve the system of custody about security legislation,criminal law,intensify through the tort liability and administrative responsibility,punishment,perfecting the legal measures on ensuring the right to education,and perfect our country about rural left-behind children protect other legal protection measures including will increase publicity and education to prevent crime,for the community organizations,public welfare organizations to provide a good legal protection,provide good legal environment for rural economic development on various aspects,many measures simultaneously,to realize the purpose of the protection of rights and interests of rural left-behind children.The author through reading a large number of papers,documents,according to the actual situation of China's rural left-behind children present,by integrating theory with practice,with cases in trial practice,side of the case,in combination with children's rights protection in the convention on the rights of children in the spirit,the analysis of our country in the aspect of solving the problem of rural left-behind children legal deficiency,put forward the perfect measures to solve the problem of rural left-behind children,let the rural left-behind children have a happy future.
