Research On Rural Community Governance:a Case Study Of Tong'an District,Xiamen City

Community governance is an important concept in the field of sociology.Nowadays China is in a critical period of social transformation,and it is an important measure to carry out community governance in rural areas to innovate rural basic social governance.The introduction of soft law governance in rural community governance is a new breakthrough in the research of the law field,and it is also an advantage in the innovation of rural community governance.From the formulation and implementation effect,the biggest difference between soft law and hard law is that policy is formulated instead by the gross-roots"community person",and its implementation is independent of state force.However,from the perspective of social effects,because formation of soft law is based on the consciousness of community,it is less apt to aggravate disputes between the parties,which are more conducive to the alleviation of relations.At present,there are many discussions about the use of soft law governance in community governance,but relatively few discussions have been discussed in rural community governance.Soft law governance in rural community governance is mainly in the form of village rules.The contents of the village rules are derived from the reverence of the village folk to the native rules,and also a consensus from the villagers.Although village regulations cannot be compulsorily implemented,in a rural folkway,its existence is deemed to be the villagers and foreign personnel's behavior of "law",and it can act as guideline function,evaluation function,prediction function and educational function which are similar to the normative function of law.In this paper,the author will base on defining rural community,rural community governance and soft law governance,introduce and analyse the four types of community governance status like the surrounding villages of Tong'an industry,the traditional agricultural villages,the remote mountain villages and the city villages,then put forward the relevant suggestions on the rural community governance in Tong'an district,with a view to promoting the rural community governance in Tong'an district.
