| The reform of the supervision system is a major political system reform that has been made on the basis of summing up the useful experiences of anti-corruption since the 18 th CPC National Congress and combining the national conditions and historical path of China.The State Committee of Supervisory formally established in March 2018 is the specific agency under the leadership of the Party that assumes the national supervision function.It unifies the forces of administrative supervision department,corruption prevention agency as well as the departments of inspection authority in charge of investigating corruption,bribery,dereliction of duty and preventing post crime.With the unprecedentedly large power,the State Committee of Supervisory must exercise the power on the track of the rule of law,following the principles of human rights protection,due process,proportionality,and independent exercise.After the Supervision Law of People’s Republic of China has been passed,The State Committee of Supervisory must also work well with the party’s disciplinary inspection agencies,judicial organs,procure agencies,law enforcement agencies and other departments to avoid unclear management responsibilities.At the mean time,it should also respond to people’s concern of “who will oversee the supervisor”.The State Committee of Supervisory should not only set up strict internal oversight mechanisms,with the separation of clue handling,discipline supervision and discipline review,but also do relevant information disclosure work and consciously accept external supervision from party committees,the People’s Congresses,judicial organs,public opinion,and citizens.In order to keep the power of the State Committee of Supervisory on the track of the rule of law,we should clear its power allocation,abide by the basic principles of its operation and perfect cohesion mechanism with other agencies.Besides,while doing internal supervision,it should consciously accept external supervision. |
