Research On The Power Allocation And Operating Mechanism Of Local Supervisory Commission

Power is not only a kind of resources,but also a scarce resource.In the field of political power,the British thinker Lord Acton famously said that power corrupts and absolute power corrupts absolutely.No doubt,it is necessary to supervise and restrict the power,so that power can be regulated in the cage of the system.The most important function of supervisory power is to make its supervisory power legal,legitimate and orderly.But the supervisory power itself is a kind of power,and it can not remove the negative attribute of power,so it also needs to be supervised and restricted.In situations where power is uncertain,power is vulnerable to abuse,and the abuse of power is extremely prone to corruption.It can even be said that abuse of power is itself a form of corruption.The ability to sort out the power allocation and operation mechanism of the Supervisory Committee helps to clarify the content,scope,and procedures of the exercise of the powers of the supervisory committee,and promote the normalization of monitoring power,thereby promoting democracy and the rule of law.From the end of 2016 to the beginning of 2017,the reform of the national monitoring system was carried out in an orderly manner.The goal of the national supervision system reform was to establish a monitoring committee and establish a centralized,unified,authoritative and efficient monitoring system.The supervisory committee is a political institution and it exercises the power of inspection.The supervisory power is expected to become the fourth power after the legislative power,administrative power,and judicial power.However,the research on the supervisory power in the theoretical circle is still relatively weak,and its power scope has not been clearly defined.This dissertation is based on the theory of the government's rule of law and the theory of power restriction.It takes the power allocation and operating mechanism of the local supervisory committee as the research subject.At the same time,it draws on the advantages of the supervisory bodies in Sweden and the United Kingdom,and finally puts forward the idea of optimizing the power allocation structure of the local supervision committee in China.As one of the earliest pilot provinces(municipalities directly under the central government),the Shanxi Provincial Supervision Commission was also the province that firstly completed the task of establishing a monitoring committee.It also made contributions to Shanxi in key links such as program formulation,establishment of regulations,and establishment of systems.Shanxi Provincial Supervisory Committee has thus become the focus of this study."Stones from other hills can be used to attack jade." Sweden is one of the world's most recognized and cleanest countries.Its parliamentary ombudsman system can be very influential.The UK,as the parliament's oldest country in history,has also brought in the parliamentary ombudsman system in the middle of the 20th century,which has further improved the parliamentary supervision.Therefore,standing on the perspective of "foreign use for foreign use",this article takes Sweden and the British parliamentary ombudsman system as comparative research objects,taking advantage of its advantages in power allocation as a reference,and finally puts forward the idea of optimizing the power of China's local supervision committees.
