On Legal Issues Of Marine Security Regulation Under Non-traditional Behavior

Since the beginning of human navigation,natural factors such as bad sea condition and extreme weather,as well as wars and armed conflicts,have been involved.Such human factors have always troubled navigation safety and posed a traditional maritime security threat.With the in-depth development of the international trade,waterway transportation plays an irreplaceable role.In recent years,due to the development of science and technology and the improvement of shipbuilding level,the ability of the watercraft to cope with bad weather and bad sea condition obviously improved.After entering the 21st century,peace and development become to the theme of the time.The effect of the war to the shipping industry has limited.Compared with the above traditional safety factors that affect navigation,the impact of the non-traditional maritime security behavior become more and more seriously.For example,piracy and armed robbery in the ocean area frequently occur;terrorist attacks are more frequent.These events have seriously restricted the development of marine economy along coastal countries,impact the world trade pattern.There is an urgent need for effective legal regulation of non-traditional maritime security behaviors.There is a lack of legal research on the law and regulation system of non-traditional maritime security and international maritime affairs.There are also conflicts between the state's legal system and the international convention.Based on the initiative of the "One Belt One Road",the author attempts to discuss the existing international conventions and regional agreements on regulation of non-traditional maritime safety behaviors from the perspective of legal regulation.To reacting well to the non-traditional safety behaviors of the sea,and protect navigation,what should we do on the legal regulation.In view of this,the first chapter,from the basic concept of non-traditional security behavior of the sea,is the overall research,researching on the background,concept and manifestation of non-traditional security behavior of the sea.The second chapter,based on the what non-traditional security behavior of the sea we have in the word now,studies the practical urgency,the practice,and the problems of regulating the non-traditional maritime security behavior.The third chapter,studies the successful case of regulating the non-traditional maritime security behavior,and analyses its mechanism and the potential problems.The forth chapter puts forward the inspirations for China on regulating the non-traditional maritime security behavior and the key points that China takes part in the international legislative activities.
