Study On Land Law Enforcement Supervision System In FuZhou

With the robust progress of economic construction in Fuzhou area,the contradiction between protection and utilization,supply and demand of land is becoming more and more prominent.The illegal use of land is more and more common,leading to the increasing difficulty in land law enforcement supervision.The land law enforcement supervision in Fuzhou area faces many problems,including legal and regulatory issues and institutional personnel and other issues.In order to solve the difficulties in land law enforcement supervision in Fuzhou area,to supress the illegal land use,and to promote the sustainable development of land resources protection and economic construction,an investigation on the land law enforcement supervision in Fuzhou area was carried out.Some suggestions were put forward.The difficulties faced by land law enforcement supervision in Fuzhou area were analyzed based on literature research,case analysis,comparative analysis and field investigation,The difficulties includes:(1)The issue of laws and regulations.The current laws on land enforcement supervision is too general with poor operability.The administrative power allocation in land management department is incomplete.The current land acquisition is too complicated,which also result in difficulties on land law enforcement supervision.(2)The problems on institutional personnel.The land law enforcement supervision is lacking in coercive power and the supervision is inefficient Law enforcement supervision system is not sound.The supervision is always passive.The supervision is always after the events instead of precaution in advance.The land management system is also not sound and the power and responsibility between departments are unclear.The independent law enforcement is difficult.There are weak law enforcement force,few staffs and the low overall team quality.And some individual law enforcement supervision departments do not administrate according to the law or administrative omission with not enough investigation and check of land use.And the technology investigation means is not advanced with lack of corresponding law enforcement equipment and low information level.The causes of difficult land law enforcement supervision in Fuzhou can be mainly attributed to the imperfect laws and regulations,and insuitable intervention by local governments.Based on the above problems and causes,the following suggestions were put forward to improve the land law enforcement supervision in Fuzhou area.(1)Impoving popularization of land laws to enhance public law-abiding awareness,including increasing publicity;(2)Clarifying the law-enforcement body,improving the system,and establishing long-term mechanism of land law enforcement supervision;(3)Strengthening the law enforcement team with strong style of law-enforcement;(4)Reforming the law-enforcement system in order to stimulate the internal vitality law enforcement supervision.
