Research On Public Participation Procedure In Administrative Decision-Making

When the rule of law is prosperous,the country is prosperous.The rule of law is the only way for the country to achieve lasting peace and stability.China attaches more importance to the construction of the rule of law in the country,and the report of the 15 th national congress of the communist party of China confirms the rule of law as the basic way of governing the country.The general goal of comprehensively advancing the rule of law is to build a socialist legal system with Chinese characteristics and to build a socialist country under the rule of law.The rule of law is the essential requirement and important guarantee of socialism with Chinese characteristics.Reform is a comprehensive and systematic task.The rule of law has greatly influenced the progress and effectiveness of China's reform,and the reform needs the rule of law.China has constantly enriched and improved the relevant theories and practices of the rule of law in a comprehensive way,which has significantly enhanced the ability of using legal means to lead and govern the country.Procedure is an essential factor for the construction of the rule of law.Administrative decision cannot be separated from the inherent requirement of the rule of law,and it cannot be separated from the essential requirement of procedural nature.The fourth plenary session of the 18 th central committee of the communist party of China(CPC)has designated the statutory procedures for major administrative decisions as public participation,expert demonstration,risk assessment,legality review,and collective discussion and decision.Public participation procedure is an important part of administrative decision-making process.On the basis of reviewing domestic and foreign literature and referring to relevant research results at home and abroad,this paper carries out research through literature research method,case analysis method and comparative analysis method.Firstly,the paper analyzes the background,purpose and significance of the research,and analyzes the collected literature.The concept of administrative decision-making,administrative decision-making procedure and public participation is defined,and the theory of public governance,procedural justice theory and citizen participation theory are expounded as theoretical support for the research.Through the study found that China's current practice of the public participation in decision-making process,although there is a further development,but there are still the main body of public participation in defining the fuzzy of symbol,inadequate public participation,public participation.Preferences affect the study found that the traditional administrative culture and government officials,to participate in the limitation of the subject,the absence of legislation,system supply,lacking the ability to guide the public participation in government is one of the important reasons leading to these problems.Finally from the government to guide the public participation ability isinsufficient,improve the level of public participation,perfecting laws and regulations and guarantee the system supply and improving the capacity of government to guide proposes ways to improve the administration of public participation procedure in the decision-making process,in order to improve the effectiveness of public participation,to ensure the democracy of administrative decision-making and scientific.
