Research On Public Participation System In Administrative Decision

With the development of democracy and legal situation, public participation has gradually infiltrated into all aspects of national political life. The administrative decision of the government has a great impact on the rights and interests of citizens, so the public participation in administrative decision-making is particularly important. The effectiveness of public participation in administrative decision-making is not only related to the realization of the citizen’s right to know, right to participate in public affairs, right of supervision, but also related to democratic legitimate and scientific administrative decision. After 30-year development, administrative decision-making of public participation in the theory and practice has made great progress, promoting the political democracy and cultivating the citizen’s consciousness. But we should also notice that there are still some problems in the system of public participation in administrative decision-making, this paper will try to put forward some improvement suggestions.The first chapter introduces the basic theories of the public participation in administrative decision. Proceed from the connotation and field of public participation, the research object focuses on the field of administrative decision-making. On the basis, the author expounds the theoretical foundation of public participation in administrative decision-making in the perspective of political science, constitutional law and administrative law. At the same time, discussing the value of the system. The second chapter studies the practice of public participation in administrative decision-making from an empirical perspective. The support of the national political provides a great driving force for the development of practice. Central and local governments are also constantly exploring and innovating in the laws and regulations and in the specific forms of operation.The third chapter studies the problems of public participation in administrative decision-making. Specifically, there are some problems in the participant and participatory process, what’s more, the effectiveness of public participation in administrative decision-making are poor, and it’s too formalistic.In the fourth chapter, the author put forward some corresponding suggestions to improve the system. The participant are becoming fully effective by enhancing the citizen’s participation awareness and ability, improving the interest representation mechanism and expert participation mechanism. The participatory process are improved by strengthen information disclosure, improve starting procedure, enacting administrative procedure law. The effectiveness of public participation in administrative decision-making are improved by establishing the mechanism of public opinion feedback and the mechanism of affixing legal liability. Finally, with the rapid development of the Internet, the paper also discusses the problem how to use the Internet to promote public participation in administrative decision-making, which is the innovation of this paper.
