Research On The Protection Of Minority Language Rights

Since modern times,The rapid economic change has brought about the global integration of economy and information,the aboriginal language and other minority language are in danger of assimilation or even repression.Based on the protection of ethnic languages and global linguistic diversity,the international society has begun to pay attention to language rights,especially those of minorities.As a multi-ethnic and multi-lingual country,correctly handling inter-ethnic relations and protecting the diversity of ethnic languages and cultures are also issues that China has always attached great importance to.Equal protection of the linguistic rights of ethnic minorities can not only save the endangered state of minority languages,spread and carry forward the language and culture of ethnic minorities,but also contribute to the unity and common prosperity of all ethnic groups,and promote the sustainable development of the country.The first part,this paper describes the endangered situation of minority languages,and puts forward the necessity and urgency of minority language rights protection research.By comparing the differences between linguistic human rights and language rights,minority and ethnic minority,and the connection and distinction between language rights and other related rights,this paper finally explains the definition and characteristics of the language rights of minority.In a broad sense,the minority language rights are both individual and collective,among which the individual rights are divided into universal language rights enjoyed by ordinary citizens and special language rights unique to minority membership.Based on the concept of substantive equality,minority language rights have the characteristics of collective,regional,non-exclusive,non-independent and binding.The second part of the article makes a brief analysis of the legitimacy of the existence of minority language rights.Firstly,as a part of ethnic problem,Language issues should be consistent with the principle of national equality,minority languages because of the influence of multiple social factors and at a disadvantage,to give special protection to minority language rights in line with the spirit of substantive equality;Secondly,the minority language rights are collective,involving the identification of national identity,and language is an important basis for national identity,in order to protect the ethnic identity and sense of belonging of ethnic minorities are dependent,it is necessary to protect the minority languagerights;Third,the political construction process of the country may damage the language rights of ethnic minorities,but the democratic government should be able to repair this violation,the protection of minority language rights can also promote the legalization of political construction;Finally,linguistic diversity,as an important part of cultural diversity,is of great significance to the sustainable development of human beings,and it is easy to produce tyranny under a single language and culture,therefore,it is necessary to protect the linguistic rights of ethnic minorities.The third part mainly introduces the legal protection of minority language rights.Since language rights are the first to cause a sensation in the international community,this paper reviews the development and change of international protection of minority language rights from the perspective of international language human rights.After that,it analyzes the current situation of legal protection of minority language rights in China,and the characteristics and achievements of minority language rights protection in China since the beginning of the founding of the people's Republic of China.The last part is the suggestions for the protection of minority language rights in China.Mainly divided into international protection and national protection,national protection in addition to the legislative,administrative and judicial aspects,but also emphasizes the participation of the whole public society in the protection work.
