Research On The Protection Of Mongolian Language Rights In Litigation

The right to speak and write of ethnic minorities is a basic right enjoyed by ethnic minorities as stipulated in the Constitution of Our country.It is the fundamental guarantee for ethnic minorities to use and develop their own spoken and written languages and plays an important role.The Mongolian language right in the lawsuit discussed in this paper is one of the inherent meanings of the minority language right.To protect the Mongolian language right in the lawsuit is to protect the minority language right and language right.China's "constitution","law on regional national autonomy",the civil procedure law,"criminal procedural law","administrative procedural law" the lawsuit right of minority language made rules,but from the current view,lawsuit right of the Mongolian language in the process of its implementation and there is much to be desired,affects the legislative intent to achieve the purpose of practical and legal rights.Based on the analysis of the practical problems and causes of Mongolian language right in the lawsuit,this paper puts forward the guarantee system of Mongolian language right in the lawsuit.In addition to the introduction and conclusion,this paper is divided into four parts in the following order:The first part is the basic theory of ethnic minority language rights in litigation.This paper focuses on defining the basic concept of minority language and writing rights in litigation,and expounds the legitimacy of protecting minority language and writing rights in litigation.The second part is about the problems in the use of Mongolian language rights in litigation.Through the analysis of tongliao city court system related survey data found that the realization of the right of litigation in the Mongolian language and Mongolian exist in bilingual legal talent shortages,lack of the lawsuit system of the Mongolian language translation,litigation in the Mongolian language rights relief system is not sound,and Mongolian bilingual problems such as insufficient standard legal documents and analyzes the causes.The third part is the experience of protecting the language rights of ethnic minorities in litigation at home and abroad.By analyzing the protection of the language and writing rights of ethnic minorities in the litigation in various ethnic minority areas at home and abroad,this paper summarizes the experience and absorbs the mature system,so as to improve the legal protection system of the Mongolian language and writing rights in the litigation.The fourth part is about the way to protect Mongolian language rights in litigation.A separate regulation was designed for the proposed Draft of Mongolian Language Working Rules in Inner Mongolia Litigation.It is determined to vigorously train all kinds of Mongolian and Chinese bilingual legal talents,establish the Mongolian language translation system in litigation,establish the Mongolian language right relief system in litigation,and standardize the production of Mongolian and Chinese bilingual legal documents four ways to improve.
