Since the second half of 2016,driven by the "Internet Plus" and the shared economic background,shared bicycles have emerged in major cities of China and have been gradually promoted to small and medium-sized cities due to their convenience,efficiency,and low-carbon environmental protection.In a short period of more than a year,with its pile-free parking,simple rental procedures,mobile phone scanning code unlocking,bike search positioning and other convenient functions,all kinds of brand new bicycles of different colors and shapes appear in the streets and lanes.As a new mode of convenience-for-people transport,the supervision of shared bicycles has become a thorny issue at present.However,relevant legislation cannot follow in a timely manner.This not only causes confusion in industry management,it also lacks legal regulation in protecting the legitimate rights and interests of shared bicycle users.Starting from the present development of shared bicycles,this paper focuses on analyzing the legal nature of the shared bicycles market.It concludes that currently shared bicycles market is faced with the following unsolved problems,such as:unregulated deposits,unclear corporate and user rights and obligations,ambiguous supervision responsibilities,illegal parking with occupation of public resources,serious damage to vehicles and other issues.In view of the fact that the appearance of network vehicles is earlier than that of shared bicycles and that the development patterns of the two have similarities,this paper believes that the development of shared bicycles can draw on the useful experience of online dating vehicles.At the same time,for the sake of optimizing the legal path for the development of the shared bicycle market,the qualifications of enterprises and industry operations should be regulated,and the involvement of government functions should also be emphasized.In deposit regulation,we propose the introduction of the third party depository mode,the setting up a special deposit depository account,and the security in deposit refund for the user;as for random parking,we suggest that the relevant government departments make timely planning,set aside space for the development of shared bikes in cities,and regulate random parking behaviors;government departments should also be clear about the regulation subject and its duty,make appropriate regulation and give active encouragement;shared bicycle enterprises should establish a sense of responsibility,improve product quality and increase investment in science and technology,and at the same time,guide the rational use of shared bikes;the user should also strengthen their self-cultivation,ensure their own reasonable and lawful use of bicycle;multi-participation should be encouraged to use optimal legal path to standardize the development of shared bike market.
