Research On The Legal Regulation Of Shared Bicycles

Since the advent of shared bicycles in 2016,they have been widely accepted and used by the public because of the low cost,convenience and low carbon environmental protection and other reasons.Shared bicycles use mobile phone APP,Internet provide people with short-term rental service.Shared bicycle does not belong to the shared economy,but is also different from the general leasing.To this end,in August 2017,ten departments,including the ministry of transport,jointly issued a file,named as <The guidance on encouraging and standardizing the development of Internet rental bicycles>,which regulates shared bicycles specially.At the present stage,there are six bicycle companies in the city of Wuhan,including Mobike?ofo?Hello bike?Kuqi Bike?New Bike and Qingju Bike.Plenty of shared bicycles are put on campus,bus stops,subway stations,residential areas,commercial districts and other different places.They are convenient for the public to travel and popular with the public.In Wuhan,there are also problems such as poor supervision,shared bicycles parking,personal destruction of bicycles and incomplete infrastructure.In reality,these problems seriously undermine the legitimate development of the shared bicycles,which is contrary to the original intention of shared bicycles to serve the people better.Shared bicycle,which is new thing,is not prescribed especially by our laws.The legal regulations for bicycle are scattered in<Road Traffic Safety Law>,<Road Traffic Safety Law Implementation>and so on.Hubei Province and Wuhan City also have local regulations and local government regulations to regulate bicycles,but only a few words.Specially applying to wuhan shared bicycles regulation is the "guidance",which regulates shared bicycles generally,not include the specific content.The government of Wuhan City has launched a normative document,called<Wuhan government's opinion on encouraging and regulating the development of bicycles retal in the Internet>.The opinion stipulate mainly the responsibility of each main part,which do not prescribe in detail.Therefore,this paper analyzes the problems existing in the development of Wuhan shared bicycles,sorts out the legal regulation measures and shortcomings of Wuhan shared bicycles,and puts forward the specific measures of Wuhan bicycle sharing legal regulation from four aspects of legislation,law enforcement,justice and law enforcement on the basis of referring to the domestic and foreign laws and regulations of shared bicycles.
