On The Protection Of Civil Rights In The NIMBY Conflict

Since 1978,China has made remarkable achievements in economic development through reform and opening up.Economic development has promoted the development of cities in China.With the continuous improvement of urbanization level,public incidents caused by NIMBY conflict are increasing.These public events have provided us with profound lessons that many public events can be avoided and solved by legal means,which finally turn to violent,collective and socialized.In order to reduce the social impact,some local governments use the way of blocking and blocking,resulting in a higher price for the people and the government.From the perspective of administrative law,this paper collates the rights of our citizens in the NIMBY conflict,and from which aspects should the government protect the civil rights,promote the good relationship between the government and the public,and have a positive effect on the settlement of the NIMBY conflict.The main content of this paper is the theoretical analysis of the concept,causes and characteristics of the NIMBY conflict.Combing out such problems that how to express their demands in a reasonable and lawful way and safeguard their rights for our citizens? In addition,this paper holds that because of the adverse impact of the NIMBY facilities on the environment,the stakeholders will have the conflict of interest in the whole process of the NIMBY facilities.How to regulate the conflict of interests between the government and citizens,fully protect the rights of citizens,and compensate the injured citizens is the key content of this article.Based on the above analysis and combing,this article from the substantive rights,procedural rights and legal relief to solve the NIMBY conflict,so as to provide reference for our country to solve the NIMBY conflict.
