Research On The Special Inquiry Of Province People's Congresses In China (2010-2017)

The special inquiry is a preliminary institutional arrangement for the People's Congress to exercise the right of inquire and supervise the "the People's Government,the People's Court and the People's Procuratorate".Since 2010,the standing committee of the National People's Congress(NPC)has made its first special inquiry,the special inquiries has been rapidly extended to the local people's congresses and their standing committees.In April 2015,the "Specific Opinions on Improving and Perfecting the Special Inquiry Work" issued by the General Office of the Standing Committee of the National People's Congress,it marked the development of the special inquiry on the path of institutionalization and normalization.This article will use 265 special inquiries conducted by 31 provincial-level authorities of the country from 2010 to 2017 as the research object.According to the provincial people's congresses and the NPC's official website,academic research articles,and various media reports,We will compile various special inquiries from the provincial people's congress and its standing committee from 2010 to 2017.On the basis of analyzing the basic situations of the special inquiries of provincial people's congresses and their standing committees,discussing the similarities and differences between the three kinds of supervision forms,observe the running track in practice.Finally,it compares the special inquiry with the supervision effectiveness of other forms of supervision,and considers the factors that affect the normal operation of the special inquiry,attempts to analyze the degree of institutionalization,the inertia of the subject and the object of supervision,and the degree of information transparency.So the top-level design is one of the paths to solving the problem.Specifically,this article is divided into five main sections:The introduction mainly explains the origin,methods and thought of the study,and sorts out the relevant research on the special inquiry both at domestic and poreign.As the same time,according to Francis Fukuyama's country-the rule of law-responsibility model as the framework of the text.The first chapter compiles the 265 special inquiries by the 31 provincial authorities in 2010-2017.As of 2014,the special inquiries have been fully covered by the the standing committee of the National People's in province.However,the province's first special inquiry and the frequency is not the same.Topics of the special inquires mainly concern the people's livelihood project,fiscal budget,implementation of laws,and government reforms.Depending on the areas of involvement,the special inquiry mainly has three forms of supervision,it forms a kind of attached special inquiry.The second chapter selects three special cases about the special inquiry to make a typical case study,and summarizes the commonalities of the three forms of supervision and the different supervision effects between tihem.As the same time,providing experience for the special inquiry to achieve nonnalization.The third chapter focuses on the existing shortcomings and the causes of the special inquiry.The main shortcomings are the imbalance of supervision intensity,lack of flexibility mechanism,low autonomy of topic selection,little interaction,and lack of binding force on the feedback mechanism;and the main reason is that the low degree of institutionalization,the obstinate thinking inertia and the low degree of Information transparency.And the last chapter is mainly based on the reasons of the single-system state structure and China's policy practice that the top-level design specification is the way to further improve the special inquiry.The research conclusion of this paper:The special inquiry of the NPC has basically established a relatively stable operation procedure,but it is still a distance from normalization.The start-up procedure is a list of the special inquiry in the annual monitoring plan,consideration of the report as a pre-procedure,the actual operation is mainly the interactive question,and form a review opinion as the post-procedure.The excellent supervision effect proves the possibility of the special inquiry's normalization,however,it is still necessary to regulate the specific operational rules of procedure from the top-level design as soon as possible.
