Research On The Construction Of The Legal System Of The Quality And Safety Of Agricultural Products

The quality and safety of agricultural products is a major issue related to residents' health and social development.Ensuring quality and safety of agricultural products is an important condition for ensuring social stability in our country.In the traditional quality and safety management of agricultural products,the government plays a role of a single entity,relying mainly on the government to resolve agricultural product quality and safety issues.However,the quality and safety control of agricultural products is a systematic project that involves multiple links and multiple entities.The traditional government-centered governance model has not adapted to the needs of China's current social development.The frequent occurrence of quality and safety incidents of agricultural products shows that the traditional quality and safety management model of agricultural products has certain defects,and the limited role of the main body of governance is one of the most important reasons.Therefore,the introduction of diversified subjects to participate in the quality and safety control of agricultural products is an important way to solve the dilemma of agricultural product quality and safety management in China.This article is based on the perspective of law,and at the same time combines knowledge from many disciplines such as economics,management,and statistics,and uses literature research methods,empirical investigation methods,comparative analysis methods,and other research methods to unfold the legal issues of the quality and safety of agricultural products in China.The study is divided into seven parts.The first chapter is an introduction.It mainly discusses the origin,purpose,and literature review of the study.The second chapter mainly defines the concept and theoretical basis,and provides theoretical support for the construction of multi-elements co-governance system of agricultural product quality;The third chapter mainly analyzes the legal status quo of quality and safety control of agricultural products.Achievements in the legal construction of the quality and safety control of agricultural products in our country and the main problems faced in the quality and safety of agricultural products and legal governance.Through the empirical analysis of the fourth chapter,we found that the dilemmas facing the multiple governance of China's agricultural product quality and safety mainly come from five aspects,namely,the cross-functionality of functions,the unclearness of the governance body,the deviation in the positioning of governance roles,the conflicts in multiple conflicts,and difficulties in coordination and linkage.The fifth chapter,from the experience of quality and safety management of agricultural products at home and abroad,useful inspirations for the quality and safety control of agricultural products in China can be summarized,which include diverse and multi-level agricultural product quality and safety laws and regulations,agricultural product quality and safety law enforcement supervision and diversification system,and sound plural judicial mechanisms.We will improve the system of social co-governance for agricultural products quality and safety.The sixth chapter discusses the construction of a multi-elemental co-governance legal system for the quality and safety of agricultural products in China,and believes that it is necessary to start with three aspects.The first is to clarify the legal responsibilities for the main body of quality and safety of agricultural products and to establish a legal system for the protection of quality and safety of agricultural products,and finally to build resources.The integration mechanism,the joint security mechanism,the sunshine supervision mechanism,and the four-subject interaction mechanism ensure that all entities have the means to participate in the multi-element joint treatment of agricultural product quality and safety.The seventh chapter is the conclusion.The innovation of this paper lies in the construction of a theoretical model for the multi-governance of agricultural product quality and safety,and based on this theoretical model,a comprehensive consideration has been given to the legal status and existing problems of China's agricultural product quality and security.It also proposes a method for constructing a multi-elemental co-governance legal system for the quality and safety of agricultural products.
