Research On The Operation Mechanism Of The Supervision Power In The Perspective Of The Rule Of Law

Supervision power is the core of the supervision system and an important part of the construction of the national supervision system.The reform of the supervisory system is also about the reconfiguration of supervisory powers.It is a systematic and arduous task.Since the 18 th National Congress,in order to effectively prevent the abuse of power and corruption and other issues,China has initiated major political reforms concerning the right to monitor.In particular,at the 13 th National People's Congress in 2018,the “Constitution Amendments of the People's Republic of China”(hereinafter referred to as the “Constitution Amendment”)including the important contents of the Supervisory Committee were passed and the “PRC Supervision” was promulgated.The "Law"(hereinafter referred to as the "Supervision Law"),this series of measures shows that China's reform of supervision power is steadily moving forward within the track of the rule of law.Therefore,this dissertation focuses on the newly adopted Constitutional Amendment and the promulgation of the Supervision Law,and conducts a comprehensive and systematic study of China's supervision power mechanism in the perspective of the rule of law.First of all,the author combs the basic connotation of the power of supervision and the rule of law,including the definition of the meaning of the rule of law,the concept of the rule of law,and the scientific connotation of governing the country according to law.It provides a theoretical basis for the further analysis of the rule of law of the operation mechanism of supervision power.A theoretical basis for the entire paper.Second,in order to effectively draw lessons from advanced experience outside the domain.According to factors such as the type of government and the responsible object of the supervisory authority,the author analyzes the model of the allocation of extraterritorial supervision power and combines it with the rankings of the corruption index of the country and region to finally draw useful inspiration.Again,the author conducted a detailed analysis of the supervision mechanism of China's supervisory power before the reform of the supervision system,and found that there are many problems,such as the imperfect legal system of supervision power,and the unreasonable supervision power structure.These problems have also seriously affected our country's The process of administering the country according to law.Finally,the author closely combines the important contents of the "Constitution Amendment" and " Supervision Law" and has designed the system for the legalization of China's supervisory powers.Mainly from the three aspects of the rule of law of the allocation of supervision power,the supervision of the operation of supervision rights,and the supervision of supervisory powers in the three aspects of the construction,and thus ensure the healthy operation of China's supervision power operating mechanism in the perspective of the rule of law.
