Research On The Restriction Mechanism Of Power Operation Under The Rule Of Law

The party's fourth Plenary Session of the 18 th CPC Central Committee promoting “comprehensively advancing the rule of law” to an important position in China is unprecedented in the Party's history.And it is a major strategic plan of the CPC Central Committee based on the history and guarantee of long-term development.The full implementation of the socialist rule of law will greatly promote our comprehensive advancement of reform,help to build an overall well-off society and comprehensively strengthen the Party discipline.It will also promote the improvement of the national modern management system and the improvement of the governance capacity.With China's comprehensive deepening reform,power restriction is one of the core issues of democratic politics.In the political society,only the power is placed under a restricted and effective mechanism can the effective regulation and control of the power be achieved.Secretary-general Xi Jinping has mentioned in several meetings the need to strengthen the control and supervision of the power operation,the need to confine the exercise of power within an institutional cage so as to form a disciplinary mechanism in which the communist party cadres don't dare to corrupt,a prevention mechanism in which the cadres can't corrupt and a guarantee mechanism in which the cadres do not easily corrupt.With our social development and comprehensive advancement of the rule of law in China,researches on the restriction mechanism of power operation in China are deepened.To build a clean,efficient,scientific and systematic power control mechanism will be of great theoretical and practical significance in the process of realizing legalization,democratization and standardization for the power operation.And it is of a positive impact to prevent power abuse and corruption,and to maintain social fairness and justice,and it also plays an important role in the affairs like further promoting social harmony,realizing the national long-term peace and stability,and ensuring that the people's rights are always used to serve the people.Based on the definitions of the related concepts,and guided by the general target and requirement of the Party Central Committee on the establishment of the power restriction mechanism since the 18 th National Congress of the CPC,and combined with Marx's theory of power restriction and supervision,this thesis attempts to explore how to build a restriction mechanism of power operation,which is strict in structure,scientific in configuration,reasonable in procedure,clean,efficient,and effective in restriction under the socialist rule of law,by adopting the methods of literature review,interdisciplinary study and experience summary.The whole thesis is composed of four parts.Part One begins with the background and significance of the study on current power operation mechanism in our country,followed by the illustration of both theoretical and practical significance and necessity of this research according to the government's important literature and agenda on power restriction mechanism.And then based the previous researches both at home and abroad,the research question,methods and the innovation highlights are put forward.Part Two offers the elaboration of the rule of law and power operation,and analysis of the logical relationship between them.Part Three is about the current situation,the problem and the internal cause of the problem of power operation mechanism.Then a deep analysis of the current situation and existing problem of our country's power operation mechanism is provided.In Part Four,strategies from four different perspectives of moral,law,procedure control and supervision on power restriction mechanism of to improve our power operation mechanism are systematically discussed.
