In recent years,the media has revealed the frequent idleness of affordable housing in China,which not only wastes huge social and public resources,but also causes the housing difficulties to fall,the government can not provide the responsibility for housing security,and the lack of legal regulation of the problem of inactive housing needs to be improved.The insufficiency of affordable housing means that all or part of affordable housing is not used,and it is in a state of waiting for lease or sale.The study of legal regulation on the issue of idleness of affordable housing is to propose concrete measures,system design,and legislative measures to prevent,control,reduce,and resolve the idleness of affordable housing.This paper describes the status quo of the problem of idle housing in China through data compilation and data analysis.It analyzes the reasons for the idleness of affordable housing and the basis for legal regulation from the perspective of public law,and finally proposes how to implement legal regulation.First of all,it introduces the basic theory of affordable housing in China,including the concepts,types and basic contents of affordable housing in China;the definition and calculation method of the rate of affordable housing.Secondly,the status quo of the issue of idle housing for affordable housing in China is introduced.Chart data are used to describe the situation of the insufficiency of local affordable housing in the country and in some provinces and cities.The specific analysis of the reasons for the problem of idle housing for affordable housing in China includes the mismatch between supply and demand,and the construction plan of affordable housing in China has obvious plans.Ineffective implementation of policies,affordable housing cannot meet the basic occupancy criteria;the system is not perfect,and the construction of affordable housing is facing Difficulties;The right to blame,the lack of legal housing security issues.Once again,the status quo and problems of legal regulation of the issue of idleness of affordable housing in China are proposed.The legal basis for the issue of idleness of affordable housing is discussed.It mainly includes that the right to housing is the fundamental rights of citizens,the state's safeguard obligation and the government'sresponsibility for affordable housing.It also elaborated on the inadequacy of the legislation and regulations on the issue of idleness of affordable housing and the lack of implementation of regulations.Finally,it puts forward how to regulate the idleness of affordable housing.The legislation system for affordable housing includes the legalization of the decision-making on affordable housing,the clear delineation of central and local jurisdictions,the establishment of a national-level “Housing Security Law” as soon as possible,and legal regulation of the construction of affordable housing to strengthen quality supervision and administration.Openness and citizen participation;legal regulation of allocation of housing for guaranteed housing,strengthening of audit supervision,and emphasis on occupancy assessment.
