Research On The Link Between Inner-party Supervision And Criminal Justice Supervision

China has been established for more than 60 years.As the ruling party,the Chinese Communist Party has made great efforts to the country's prosperity and people's welfare,and it has achieved fruitful results.However,as a party with huge public power in hand,the Chinese Communist Party should also keep in mind to supervise itself.It is worth rejoicing that,in the eighteenth congress held by the Chinese Communist Party,the construction of inner-supervision has been enhanced.And the functions of the inner-party supervision departments have been confirmed at all levels,including system and procedure.The sixth plenary session of the 18th CPC central committee has examined and passed the regulations of inner-party supervision.It turns the practice of the inner-party supervision into a great achievement and provides the top-level design and basic system for strengthening the supervision under new situation.It is of great significance for the party to improve self-renewal and self-improvement in the long term.Facts show that the guiding ideology and policy of inner-party supervision are correct and productive.But it does not mean that the construction of inner-party supervision can be stalled.Some important departments,local party members or leading cadres still have the phenomenon of violating laws and regulations,corruption and malfeasance.It requires that the party should not be satisfied with the current situation,but should continue to explore the perfect direction of the new supervision system.The regulations on the supervision points out clearly to combine inner-party supervision and external supervision,and emphasizes on that after the party disciplinary,the party member and leading cadre who violating the laws must be transferred to the criminal judiciary processing for criminal responsibility.Through the understanding of the relevant party,s regulations,it is clear that the main contents of the combination of the two supervisions are as follows:the mutual transfer of illegal cases,following the case after transferring of the Commission for Discipline,informing the Party Committee and the Discipline Committee at the same level on the major cases when involving the leading cadres in the party.The supporting and guaranteeing functions of the organ performing its supervisory function.Therefore,the idea of improving the cohesive system of inner party supervision and criminal judicial supervision should focus mainly on how to achieve the above cohesion and guarantee the effect of cohesion,which is based on this thinking and discussed.The article is divided into four parts:the first part elaborates the basic concepts of the coordination system between inner-party supervision and criminal justice supervision,and analyzes the relationship between them on the basis of introducing the meaning and characteristics of inner-party supervision and criminal justice supervision,The second part introduces the necessity of the coordination between inner-party supervision and criminal justice supervision on the basis of their relationship.And then introduces the theoretical basis of the connection from the theory of power balance theory,the theory of rule of law and the construction theory of anti-corruption system.On the basis of organizing the relevant party rules and regulations,this paper summarizes the institutional basis for the connection between the two parties,which indicates that the connection between party supervision and criminal judicial supervision is not rootless wood and no source of water.The third part analyzes the current situation of the practice of inner-party supervision and criminal justice supervision.Through the investigation of the legislative norms and the analysis of the transfer data of the violation cases,it try to find out the problems in the connection and improve them.The fourth part describes the basic idea of perfecting the connection system between inner-party supervision and criminal justice supervision.On the basis of the foregoing problem analysis,from the perfect system of norms,establish cohesion system principle,strengthening the cohesion subject,supervise violations cases transferred,the perfection of the mechanism of form a complete set of institutions and so on five aspects,to connect system and the improvement of the national supervision system to provide ideas and direction.
