An Analysis Of The Conflict And Coordination Of Media Supervision And Judicial Justice

Judicial justice is one of the important connotations of social justice. With the gradual deepening of the rule of law concept, problem of justice is increasingly getting the attention of the public. Besides, how to supervise justice also becomes an important subject of the judicial work. Compared with the traditional internal supervision of the judicial organs, newly emerged media supervision has its unique superiorities:media supervision main body has the universality, flexibility, targeted objects. Because of this, the media, as a kind of external supervision, is indispensable to guarantee judicial justice supervision mode. In practice, however, some media’s biased reports, inaccurate reports, wanton incitement, or even media corruption not only do no good to supervision and judicial justice, but also put huge pressure on the judiciary, or even lead to the judicial intervention, formed the "media trial" phenomenon. Therefore, it is necessary to build the media supervision and judicial justice coordination mechanism, in order to form the benign interaction between them.There are many domestic scholars on the relationship between the media supervision and judicial justice, but most of the researches didn’t distinguish between media supervision and supervision by public opinion, so that there is confusion in the study. To this, the author will be restricted on the media supervision subjects, using empirical analysis, case analysis, comparative analysis and other research methods, to analyze the relationship between the media supervision and judicial justice. What is more, the author also puts forward suggestions for the construction of coordination mechanism between them.This article begins with the typical cases of media supervision and judicial justice through the case to analyze relationship between media supervision and judicial justice. In-depth analysis of the relationship between media supervision and judicial justice is also included. On the one hand, by understanding the positive meaning of judicial justice, media supervision must be insisted and strengthen. On the other hand, the negative influence of media supervision on judicial justice is also discussed, and the performance of media supervision and judicial justice conflicts and reasons are analyzed. Consequently, the article will come to the conclusion that the boundaries of media supervision and regulation must be set up. Media supervision and judicial justice coordination mechanism will rise up the following suggestions:On the one hand, the rights of media supervision needs to be guaranteed, at the same time to make some regulation about media supervision; on the other hand, the judicial organs should be tolerant to the media supervision, at the same time, the judicial organs should dare to refuse improper interference by the media.
