The standardization of local government authority allocation is the premise and foundation that to clarify the function scope of the government at all levels and effective supply of public goods and services,is an important guarantee for local governance effectiveness,which relates to the reform of the administrative system,financial system optimization.The third Plenary Session of the 18 th CPC Central Committee is to be used as an important part of the national governance system and governance capacity modernization.In 1994,the distribution system was designed for the first time in the form of standard text,forming the overall layout for more than 20 years thereafter.However,with the country stepping into the transition stage,the economy entered a new normal.The tendency of social stratification intensifies,and the current mode of allocation of local intergovernmental power becomes out of place,which is incompatible with the requirements of national development,social governance and market economy.From the current situation of powers division,on the one hand,the supply of legal system is insufficient,the degree of rule of law is low,the legal basis is weak,those are the most fundamental feature,the reality of powers distribution does not meet the theoretical requirements of legal allocation.No legalization configuration system has been formed.On the other hand,the "path dependence" factor in the administrative system leads to the confusion of the overall allocation pattern,and the traditional administrative decentralization increases the uncertainty and arbitrariness of the division of administrative power."responsibility isomorphism" leads to alienation of economic standards of power allocation,it means the axis of power allocation in our country is not based on the functional scope of all levels of government and the level of public goods,but according to the will of the superior,all economic and social affairs are contracted out step by step until the lowest level of government to share the burden.As a result,the subject of power is not clear,the power of cross affairs is blurred,and the right of finance is collected.The subsidence of power appears one after another,and the "pressure type system" with the performance promotion championship mechanism makes the center of distribution deviate,thus the public responsibility of the government become weaken.At the same time,the change of government-led power allocation makes the external forces such as local people's congresses,judicial organs,social organizations and the public weak role.The government's "one speech hall" leads to the imbalance phenomenon in the division of administrative power.We should re-examine the ecological environment of power allocation at the present stage,form the allocation system within the framework of legal system as soon as possible,and straighten out the pattern of hierarchical division and rule.It is the only way to realize the standardization of the allocation of the local government's power to make clear the power of government at different levels and to construct the multi-center participation mechanism of the division of the administrative power.The full paper is divided into six parts:The first part is the introduction: firstly,put forward the core question: why government powers allocation reform continues but has not made substantial progress,the powers of local governments exactly how difficult the problem in the process,what is the reason of formation.Then literature review of the allocation of government powers,finally to explain the difficulties and research methods.The second part is the basic concept and analysis framework of the allocation of government power.In the light of the power involved,the government power and its related conceptual relationship are explained,and the basic analysis framework of the allocation of power is analyzed.It points out that the two standards of power allocation in theory are economic standard and legal standard.The third part is the history of local government power allocation.It is mainly divided into four periods: the period of power recovery and loss of norms,and the period of non-standard "decentralization and profit transfer".Since the reform of the tax distribution system and the new stage of power allocation,the realistic evolution of power allocation in China has been observed through a clear historical context,which lays a foundation for explaining the present situation of the power of affairs.The fourth part mainly explains the existing pattern of the local government ' s rights allocation in our country.On the basis of this,the deep level of the current situation is analyzed.The legal system is missing,the level of the rule of law is the first level,which leads to the lack of the legal standard,and the administrative "path dependence " factor replaces the law to become the axis of the disposition of the right.It leads to the confusion of the whole pattern,the system obstacle of the division of administrative power,and the weak external force,which results in the imbalance of the distribution of the power.The fifth part is the path optimization idea of the standardization of the allocation of the local government power in our country.In view of the present situation of the division of the power of affairs,we should form the allocation system within the framework of the legal system,promote the degree of the rule of law,and straighten out the hierarchical pattern of division and rule.Make clear the power of different levels of government,and construct the multi-center participation mechanism of power division.The sixth part is the conclusion.By summarizing the problem consciousness and the path Countermeasures in the previous article,the research logic of the issue of the local government's power allocation is formed,and the sublimation is summed up.
