This research aims to study the detention conditions of suspects who are in special infectious diseases.The main research objects include suspects and defendants who suffer from infectious diseases such as AIDS,hepatitis,tuberculosis and syphilis.This article includes four sections excluded the introduction and the conclusion.Section one introduces the rules of special illness suspects and the law in reality.Section two sheds on light to summarize the problems of the detention of illness suspects and analyze the reasons.Section three describes the United Nations' suggestions and the advanced experience of custody of patients in other developed countries.Section four proposes some solutions to solve the shortcomings.Currently,although some special detention centers,which particularly be used to imprison AIDS patients and other infectious diseases guilty patients,have been established in some areas;there are also some problems exist.For example,the detention of infectious suspects is restricted and detention centers lack the program to treat infectious diseases.In practice,detention centers in different places have different custodial measures for criminal suspects.Due to the limited conditions,most of suspects who are in special diseases or infectious diseases are not permitted putting into the jail.Some detention centers established a special surveillance zones for special diseases detainees.Some do not isolate special diseases detainees.Here are several reasons about why different areas have different measures: the imperfect legal provisions,the low medical socialization in detention centers,the poor medical equipment and so on.Compared with other countries' pretrial detention systems,there are still many aspects which need to be improved in our country.Therefore,in view of the status quo of patients' suspects in our country,combined with the advanced foreign experience,the detention system should be constructed from the following three aspects: perfecting the relevant laws and regulations,improving the ability of detention centers,finding alternative detention measures for special patients' detainees.
