With the acceleration of the process of economic globalization,the global market has gradually taken shape,and investment among countries around the world has also become more liberalized.In order to follow the wave of globalization,investors should pay attention to the investment legal system of the host country,and the investment-importing countries need to constantly adjust and develop.China and Mongolia are close to each other and both sides have extensive and in-depth cooperation and exchanges.Since the 1990s,China has been the largest source of foreign investment in Mongolia.With the construction of the "Belt and Road"initiative,the economic exchanges between China and Mongolia will become more frequent and deeper.Because of the differences in political and economic environment between the two countries,there is a big difference in the construction of the legal system between the two countries.In 1979,China promulgated the first foreign investment law,the "Law of the People's Republic of China on Sino-Foreign Equity Joint Ventures." After more than 30 years of accumulation,China has established the "Sino-Foreign Equity Joint Venture Law" and the "Sino-Foreign Joint Venture Law." The legal system of foreign investment is the core of the three laws of"The Law of Foreign-funded Enterprises".Mongolia officially promulgated the"Mongolian Investment Law" in 1993,laying the legal foundation for foreign investment in Mongolia in the form of a code.From the beginning of the legislation of foreign capital law to the present,the economic policies and economic development levels of China and Mongolia have undergone great changes.The law of foreign investment in China and Mongolia has also changed from the legislative system to the specific system.This article mainly compares and analyzes China's and Mongolia's legislative styles,scope of application of laws,investment forms of foreign companies,market access systems,investment treatment systems and dispute settlement systems,and hopes to provide guide to foreign investment practices for the two countries.
