Research On Improvement Of Judge Responsibility System Under The Background Of Post System Reform In China

The report of the 18th national congress of the CPC pointed out that further deepening the reform of the judicial system and improving the judicial system of socialism with Chinese characteristics.After that,the decision of the CPC central committee on the major issues of comprehensively deepening reform,and the decision of the CPC central committee on the major issues of comprehensively promoting the rule of law,further pointed out that,we should reform the judicial management system,improve the system of judicial personnel classification and management,and let the adjudicators be responsible.We will carry forward the reform of the judicial system,which is the center of the trial,and carry out the system of lifelong responsibility for handling cases and the accountability system for wrongful cases.To implement the central file spirit,the supreme people's court promulgated the comprehensive's opinions on deepening the reform of the people's court,will improve the presiding judge,the collegial panel case responsibility system into the people's court reform tasks.It can be seen that the judge's responsibility system is an important part of judicial reform in our country.In the context of the current reform of the "post system" of the people's court,the original judge accountability system cannot meet the requirements of the new era.How to adapt to the requirements of the reform of the "post system" is a hot issue discussed by the theoretical and judicial substantive departments.In this paper,according to the background of the reform of the people's court "categories","number" and the judge responsibility system,the relationship between foreign judge responsibility system,analyzes the present situation of the judge responsibility system in our country and the existing main problems,according to the value goal of the reform of the judge"categories",put forward concrete measures of perfecting our country's judge responsibility system.The paper is divided into four parts:The first part,the relationship between the "post system" and the judge's responsibility system.To explain the meaning and characteristics of the "post system" of judges,the background and significance of the reform of the "post system",the meaning and value of the judge's responsibility system,and the relationship between the "post system" and the judge's responsibility system.The second part is the investigation of the responsibility system of judges outside the region.It focuses on the judicial responsibility system of the United States,France,Germany and Japan.From the scope of the judge's responsibilities,the subject of the judge's responsibility,the judge's responsibility for the proceedings,and the main content of the responsibility system of the four countries,and on that basis,it points out the significance of the foreign judge's responsibility system for our country.In the third part,under the background of the reform of "post system",judge's responsibility system is under review.Based on the value goal of the reform of "post system",this paper analyzes the present situation of judge's liability system in China,points out the main problems existing in the judicial system of judges in our country,and analyzes the causes of the problems.The fourth part,the "post system" reform background perfect our country judge responsibility system countermeasure.The main problem of the judicial system of our country,and the good experience of the foreign judge's responsibility system,is to improve the specific measures of our judge's liability system.
