With the rapid development of the economy and the profound impact of network technology on the economy,society,government governance and our personal life,the new types of employment models are gradually increasing,and China's relevant laws and regulations have not unified the identification of labor relations for flexible employment.The relationship between flexible workers and related companies presents a variety of models,whether their relationship is labor relations or a new era of interpretation of labor relations,we are currently in need of positive right question.In the judicial activities,a large number of cases do not recognize the labor relations of the relevant flexible employees,which leads to the lack of judicial relief in the labor relations related disputes.Therefore,we need to be between the new flexible employees and related enterprises.Labor relations are re-recognized,and our relevant laws and regulations also need to respond positively.Flexible employment,with its high flexibility and low threshold,has attracted many workers to join.The advent of the information age has also promoted the development model of a new economic structure based on the network platform,and new flexible employment has emerged.The new economic model and flexible labor relations not only open up new development paths for the entire social and economic development,but also provide more employment opportunities for workers,which is conducive to improving people's living standards and promoting the prosperity of different economic models of society.Development will further promote the harmony and stability of society.But at the same time,it also presents a realistic problem: the current law still has many problems to be solved and perfected for the protection of labor rights and interests of flexible workers.The outstanding problem is how to determine the labor relationship,without the recognition of labor relations,there is a great difference between the flexible employment group and the non-flexible employment in the protection of labor rights.Therefore,through in-depth discussion of labor relations theory,this paper further analyzes the status quo and existing problems of labor law guarantee legislation for flexible employees,and provides suggestions for safeguarding the labor rights of new flexible employees.It also hopes to provide meaningful theoretical exploration for government practice departments.result.The first part of the thesis explores the theory of labor relations and the conceptual interpretation of new flexible employment.On the one hand,it explains the meaning of the flexible employment model from the practical level,on the other hand,it discusses the main characteristics of the new flexible employment labor relationship and conducts in-depth research on its identification standards.The second part expounds the current situation of the labor security legislation of the new flexible employment personnel.Through the comparative analysis of the cases,the relevant laws and regulations on the labor security of the new flexible employment personnel are sorted out.The third part analyzes the problems existing in the protection of labor rights of new flexible employees.Because the labor relations identification standards are not uniform,the current laws and regulations have no clear regulation on the identification of flexible employment,which leads to the failure to identify new flexible labor relations in judicial practice,which means that labor rights cannot be obtained more powerfully relief.The fourth part proposes measures to improve the protection of labor rights and interests of flexible employees.In the legal system,we will further improve the systemic and normative nature of the new flexible employment labor legislation.The relevant labor regulations should clearly identify the new labor relations subject,unify the labor relationship identification standards,and the existing relevant laws should deal with the new type of labor in real life.The relationship is magnified to respond to the issue of rights protection caused by new labor relations in the Internet age.
