Study On The Countermeasures Of Protecting Labor Rights And Interests Of Outlets In Dalian City

The emergence of network delivery member has made irreplaceable contributions to the development of “Internet+” in China.However,their legitimate rights and interests in the political,economic,social and other aspects have been infringed.As for labor rights which are closely related to their survival,compared with the labor they pay,the labor rights enjoyed by the laborers have been seriously infringed in many aspects,like labor relations,labor remuneration,rest leave right and labor rights and interests.Their pay is not proportional to the return.This paper analyzes the current situation of the damage to the labor rights and interests of the network delivery member.There are many reasons for the loss of workers' labor rights.First,lack of special online food delivery industry regulations.The fundamental reason for the damage of their labor rights and interests is the fuzzy labor relationship of the network delivery member.Therefore,the labor law and regulations should be improved as soon as possible.Second,network take-out industry belongs to the emerging industry and don't have their own network of consumer electronics business associations to monitor and manage.Moreover,the quality of hiring enterprises is uneven.Third,the development of grass-roots trade union organizations lags behind;the function of trade union cannot be effectively applied;the network takeaway has little confidence in the trade union.All of these lead to infringement of labor rights for network delivery member while the legal system and trade union work are constantly improved.For the above reasons,this paper analyzes the problem from the perspective of public policy implementation.First,the government should as soon as possible to determine the attributes of network labor.Government should carry out special regulation on the online delivery industry;strengthen labor supervision;crack down on the rights and interests of various online food delivery workers.Second,establishing electricity supplier association;standardizing the threshold of enterprise access;ensuring the regularization of employment enterprises at the source.Last,from the perspective of trade union execution,promoting grassroots trade union organizations,the trade union carries out policies to guarantee the salary,contract signing and other rights of the room service workers and moreover to guarantee the labor rights and interests of network delivery member.
