Railway passenger transport,with the advantages of heavy transportation capacity,high cost-effective,has gained the trust and favor of the vast number of passengers.But in railway transportation activities,train delays is a problem that the passenger must face,which not only affects the passenger,,but also affects the railway transportation enterprises.Along with The Belt and Road Initiatives"Chinese Railway"go out "and"Railway Legal System "of the national strategy implementation and further,to solve the problem of train delays is more urgent and more important.Based on a large number of documents,in combination with the questionnaire,the typical cases or instances of train delays in China are collected,and five reflections on cases or instances of train delays are carried out.The train delays is a breach of contract in terms of its legal nature,which infringes passengers' punctual delivery rights and interests,the carrier needs to bear the corresponding liability for breach of contract,but train delays is not equal to the late compensation,the carrier is exempt from liability under the circumstances of force majeure.Analysis of train delays,like the shortage of railway transportation,meteorological disasters,geological disasters and other natural barriers,and improper management of railway operation with the lack of coordination,railway equipment maintenance and construction,passenger travel illegal and train operation accident are the direct influence of the operation of the train and thus cause train delays;the legislative and judicial security about train delay is insufficient,the railway transport enterprise ignored train delays,the regulatory body of the railway transport service regulation is not in place and the relief about train delays is not perfect,this is not effectively solve the problem,and even contribute to the occurrence of the train delay.Through the analysis of the case of delayed train,research on delayed passenger trains.Deep roots by digging behind the passenger train delay problem,the emphasis is to put forward novel and operable solutions from the perspectives of law,technology,supervision and management and right relief,specifically,there are mainly the following measures: railway transport enterprises can improve the capacity and efficiency,and use technology and management to control the possibility of train delays;to supervise the implementation of the supervision obligations of railway transport services;enhancing legal awareness among passenger and the public;the state and the railway transport enterprises jointly improve the train delay relief approach.
