Research On The Legal Supervision Mechanism Of PPP Model Of Urban Rail Transit Project In China

The utility program of PPP mode in China has been born for many years,and all over the country has risen up in this years.But the complexity of PPP projects usually involves multiple interests,as a result,the project in the construction and operation phase will produce a variety of problems.As a typical public utility project,urban rail transit project needs more financial support because of its particularity,so investment and financing is the most difficulty in the development of the project.Especially in recent years,when the economy is developing slowly,the government's investment in public projects is restricted by many restrictions.For the urban rail transit project which needs a lot of investment,the simple financial funds can not support the implementation of the landing,and it is also the main reason that some urban rail transit in our country can not be completed and put into use.Therefore,the urban rail transit projects in China also use the PPP model to try to solve the problem of financial difficulties by introducing social capital.The PPP model of urban rail transit project is the most novel attempt.The project construction of some cities across the country is "crossing the river by feeling the stone",over the all process,it will inevitably lead to inconsistent with the original intention of the implementation of the project,and even harm the interests of the public,social investors and government parties.Therefore,the implementation of the guarantee project needs to be supervised through many ways,among which the most important means is to rely on the legal supervision and make the project run in all directions and healthily under the guarantee of the legal system.At the same time,in 2017,the Ministry of Finance issued two important documents in succession to further restrict the construction of public utilities projects in China,strictly restrict the power of the government,regulate the investment mode of social capital,and control the channels of investment and financing.To support the development of real PPP projects.Based on this,this paper is divided into four parts to study the legal supervision mechanism of PPP mode of urban rail transit project in China.The first part summarizes the PPP model and the urban rail transit project,and then analyzes the significance of using the PPP model in the urban rail transit project,and interprets the two documents issued by the Ministry of Finance.The second part mainly summarizesthe current situation of the legal supervision of urban rail transit projects in China from the following three aspects: the regulatory legislation,the regulatory body and the legal responsibilities,so as to analyze the major predicaments faced by the current legal supervision.The third department mainly concludes the experience of the legal supervision of urban rail transit projects in Britain and the United States,and provides a reference for the legal supervision of the urban rail transit project in China from various aspects such as legislation reference,system design and clear responsibility.The 4th part mainly summarizes the legal supervision mechanism suggestion of perfecting the PPP mode of the urban track project in our country.It expounds from the three aspects of perfecting the legal system,setting up the appropriate supervision subject and strengthening the legal responsibility of all parties.In order to provide some theoretical reference for the development of urban rail transit projects in China.
