On Legal Regulation Of Bribery Election Of Deputies To People's Congresses

In our country,voting and to be voted are the main ways for citizens to participate in state affairs and exercise their own power according to law.Deputies to people's congresses at all levels are members of the national and local organs of state power.They represent the interests and will of the people,and exercise state power in accordance with the Constitution and laws.Their status is sacred and solemn.Bribery election in the election of deputies to people's congress directly from the source destroys our electoral system and erodes the foundation of the system of people's congress.Judging from the time of democratic elections in various countries of the world,it is difficult to thoroughly eradicate the practice of bribery election.We cannot deny the electoral system and the the system of people's congress of our country on that basis.However,it can not be denied that there are many problems in the current electoral system of our country,such as the lack of clear legal definition and standard of confirmation to bribery election,imperfect electoral system,uncompetitive elections,incomplete procedural provisions and so on.The occurrence of two large-scale cases of bribery election in Hengyang and Liaoning people's congress reflects that there are gaps in the provisions of the electoral system in our country.Legislators have not taken into account the fact that the occurrence of large-scale bribery election will result in the failure of the first-level people's congresses to carry out their functions,and naturally there is no provision for the handling of the aftermath of similar situations.This paper intends to discuss the legal regulation of vote-buying of deputies to the people's congress from two aspects.On the one hand,through the analysis of the reasons and manifestations of bribery election of deputies to the people's congress of our country,this paper puts forward some suggestions for perfecting our electoral system,including the perfection of the nomination mechanism of candidates for deputies to the people's congress of our country,the strengthening of the competitiveness of election activities,the establishment of a clear election supervision department and supervision mechanism,the refining of the procedural provisions of the election,etc.On the other hand,this paper discusses the issue of dealing with the aftermath of bribery election,especially large-scale vote-buying.Also,this paper discusses the issues of perfecting the recall mechanism of deputies to the people's congress,the legal status of the preparatory committee of the people's congress,the effectiveness of performing duties of the deputies to the people's congress who participate in the bribery election and then puts forward some corresponding suggestions.Finally,this paper discusses the relevant systems of the people's congresses of our country,and suggests that the minimum number of people for the convening of people's congresses at all levels should be defined and the hand-over procedures between the previous and the next people's congresses should be perfected and so on.
