Forty years of reform and opening up,with the rapid development of the economy,the country has undergone earth-shaking changes,but regional economic development has been uneven,inadequate,structural imbalances in population growth,depletion of demographic dividends and other issues are gradually emerging.In the long run,the urgent demand for foreign high-end talent and the continuous reduction of domestic cheap labor force have formed the dual characteristics of China's attraction of foreigners to work in China.However,over the years,China has not made substantive breakthroughs in the legal system for the introduction and management of foreign workers,which has hindered the pace of social development to some extent.Therefore,timely adjustment of the direction of legislation to solve the existing shortcomings and inadequacies in the employment laws and regulations of foreigners in China,perfecting the administrative supervision system for the employment of foreigners in China,and providing guidance for the future introduction of intelligence to China and the management of illegal immigration have become extremely urgent.This chapter starts with the introduction of definitions,explains several concepts concerning the administrative supervision of foreigners' employment in China,and analyzes the parts that are apt to cause confusion,which in turn leads to the four hazards of foreigners' employment violations of administrative supervision.Through the analysis of the status quo of foreigners' employment in China,we pointed out the difficulties faced by our country in attracting intellectual work.The second part of the article uses an empirical analysis method to collate and analyze China's current legal norms concerning foreigners' employment in China,and tries to summarize and summarize the advantages and disadvantages of the hidden foreign investment.It provides valuable basis for the targeted construction of foreign employment administration supervision system in China.The third part of the article uses comparative research methods to analyze the specific practices of the power division,system design,and supervision model for foreign employment supervision in developed countries such as the United States and Singapore.The unique characteristics and universal experience in the regulatory system of developed countries were also studied.Summarized,laying the groundwork for making relevant legislative proposals below.Finally,the article uses the inductive reasoning research method and puts forward various ideas.Such as raising the level of legislation,clarifying the main body of administrative supervision,simplifying administrative supervision procedures,adopting diversified legal accountability methods,and adopting open-ended policies.With a view to perfecting China's employment administration and supervision system,it is necessary to ensure that overseas talents participate in economic and social construction,strengthen China's international competitiveness and national innovation,and do a good job of legal protection.
