Study On Inner-party Election Supervision

In modern politics, political parties are the major contenders for political power. When a political party acquires the ruling position and merges deeply with state power, its internal behavior may have a significant impact on the country and the society, which makes it necessary to oversee the internal activities of the ruling party. Inner-party election, as the main way to delegate power within the party, is one of the most important internal activities of the ruling party. Therefore, it should become an important aspect of the supervision. The Nanchong Bribery Scandal reveals many problems existing in such supervision process, and revokes the need for a re-examination on our current supervision system. This thesis starts from the basic theory of inner-party election supervision and touches on many aspects of supervision, including its subjects, object, standards, forms, procedures, working mechanisms, relief methods and procedures, etc., with the aim to outline the contours of inner-party election supervision and to push forward the development and improvement of the supervision system.This thesis consists of four parts. Here below is the summary for each part.Chapter 1:general theories on inner-party election supervision. This chapter mainly elaborates related concepts, basic principles, function and guidelines. Inner-party election should not only follow the party constitution, party laws and regulations, but also obey the National Constitution and Laws. The basic principles includes overall supervision and supervision according to laws. The functions of inner-party election supervision include letting the related regulations to play its role, promoting the construction of legal systems, providing legal basis for the delegated power and preventing the abuse of public power inside the party. Five scientific supervision guidelines are proposed, that is, supervision according to laws, supervision without fear, supervision with wisdom, supervision by people, and supervision with efficiency and fair.Chapter 2:The subjects objects and standards of inner-party election supervision. This chapter first analyzes related laws and regulations on the subjects of inner-party election supervision. It points out the shortcomings of existing regulations and its negative effects on the supervision practice. Based on this, proposals are made on how to improve the subjects of supervision. Secondly, with standard analysis, it is concluded that those individuals and organizations who take part in inner-party elections are the objects of supervision. Also the scopes of inner-party election supervision are further elaborated. Finally, from the perspective of ensuring the effectiveness of supervision, it is illustrated that legal investigation is the principle for investigating inner-party election activities and six basic principles of elections are the specific standards for investigation.Chapter 3:The forms procedures and working mechanisms of inner-party election supervision. This chapter first explains the major supervision forms and points out the current forms are not able to cover all supervision tasks. Suggestions regarding how to improve supervision forms are put forward. Supervision systems of each supervision form are described in details. Then on the basis of related inner-party laws and regulations, with reference to supervision practices and theoretical points of view, applicable procedures involved in concrete supervision systems are outlined. In the end, the thesis explores the construction of working principles and mechanisms for inner-party election supervision in three stages, which are supervision initiation, supervision investigation and supervision feedback.Chapter 4:Relief on inner-party election supervision. This chapter first demonstrates the necessity of relief on inner-party election supervision. It is pointed out that such relief is an important measure to both ensure the legal rights and interests of those supervision objects and avoid the abuse of supervision rights. Furthermore, two ways of relief, inner-party relief and external-party relief are mentioned; details about applicable relief methods and procedures are illustrated.
