| The network booking taxi(hereinafter referred to as "net car")is a new product of the era of Internet plus big data.With the booming development of shared economy,the innovative industry mode is expanding.But at the same time,the operation of network related cars has begun to cause many problems.Although the central and local governments have formulated relevant policies for these problems,there is no special law for the management of Internet related vehicles in China.The existing network management system is not high enough,the system is not perfect,the procedures are not standardized,the execution is not strong enough,and the management mode is not scientific,which makes the development of the network car stagnate at one point.Therefore,in order to ensure the healthy and orderly development of emerging industries,according to the characteristics of the current network about the car business,analyze the existing business process network of our country about the car in the construction of legal system present situation,the existing system implementation,network system about car business to encourage demand and other aspects of the situation and learn from foreign advanced experience about the car network management,tries to put forward some suggestions for further perfecting the legal regulation about the car business network.This paper mainly includes four parts.The first part starts with the analysis of the theory from the network about the car business,clarify the concept and characteristics of network about cars,the concept and significance of the legal regulation of the network about the car business is expounded,the theoretical basis for the following analysis of problems;the second part firstly in theory combing the administrative regulations and normative documents,the existing system of law in our country network management about the car,and then summed up the market in the network about the car business access,government regulation,fair competition,insurance,legal liability five aspects from a practical operational level;the third part is the foreign network about the car business and the legal regulation model of comparative analysis,selected the United States,Britain,France and Singapore four countries legal regulation mode,in order to enlighten the legal regulation of network of our country about the car business;the fourth part mainly puts forward the solution about the car business access network Legal regulation suggestions on issues such as regulation mode,fair competition,insurance coverage and legal liability undertaking will form a systematic and perfect legal regulation mode of net car operation,so as to provide institutional guarantee for the development of China’s Internet related vehicles. |
