The Chinese police system was established in the changing period of the late Qing Dynasty,while the policewomen did not mount the Chinese historical stage from Shanghai until the Republic of China.Policewomen has always accounted for only a small proportion in the huge police system in the world,which is a universal problem.In the Code of Criminal Procedure,it explicitly stipulates that female staff must be present in the examination and search of female suspects,but in fact,most of the inspection is completed by male staff because of the lack of grass-roots policewomen.This wide range of non-compliance and illegal behavior not only concerns a problem of unfairness of the system and the deficiency of the rule of law,but also involves issues such as the deep gender inequality,social structure and so on.During the internship in the local police station,the author investigated this issue and found that the absence of a policewomen in the local police station is quite commonplace.This means that a large number of female suspects have to be inspected by male staff every year,in other words,these female criminal suspects' rights of privacy have not been given the most basic protection and respect.Therefore,the absence of policewomen is not only a matter of the police system,but also a matter of the protection of women's rights.Policewomen are likely to encounter sexual harassment while working or taking notes,which all male criminal suspects will not encounter.Therefore,although the absence of policewomen is a small problem,it is related to the basic national policy of equality between men and women.However,the absence of policewomen has not been correctly recognized and the contradiction is still intensifying: Many public security colleges and universities across the country restrict the number of women when enrolling students.which is suspected of blatant discrimination against women's right to education and labor rights,and it makes it more difficult for public security organs to recruit policewomen.The author makes a comprehensive analysis of this issue from the perspective of gender philosophy and sociology of law,trying to reveal the deep logic of the deficiency of policewomen.The value of this research is not only to improve the police system,but also to put forward the construction of gender justice,and solve the discrimination,misunderstanding,contradiction and dispute arising from gender.This is not only a solution to the lack of policewomen,but also a good way to solve the problems of gender unjust in China and the world.
