Research On Dongguan Migrant Worker's Crime Problem

Since the 21 st century,as China's rapid economic development,under the city and countryside dual economic structure,a large number of surplus labor force into the city engaged in non-agricultural production,formed a group also workers also farmers,as we called—migrant workers.Due to various reasons,migrant workers has been the social vulnerable groups,their living conditions did not improve significantly,the gap between rich and poor was still rising,as the result of a series of social problems,the most prominent performance was the crime trend of migrant workers,which has caused social widespread concern.C hina is an agricultural country,without study on C hinese farmers,without understanding of C hinese society.To understand the current situatio n of the development of C hinese farmers,we must pay more attention to migrant workers.According to the research target,this paper identified as the research object as the migrant workers who has been transferred to prosecute the suspect by Dongguan dete ntion house.This study mainly adopts the methods of literature research,questionnaire investigation,statistical data analysis,and combine with system theory research.One of the statistical analysis of data from 2013 to 2015,is mainly to various indexes of migrant workers,who had transferred to prosecute by Dongguan detention house,and a questionnaire survey is focused on rural migrant workers in 2016 has been transferred to prosecute,combined with some individual interviews,attempts to analyze some basic features of migrant workers crime and related influence factors.The main contents of this paper are:1.Through the investigation and study,we found that migrant workers crime occupied certain proportion for all kinds of crime in Dongguan.Crime a gainst property such as theft,fraud,robbery,kidnapping,extortion,homicide,injury,rape and other violent crime,gambling,prostitution,whoring and other social evils such crime,and so on.But migrant workers engaged in unlicensed illegal business,tax evasion,involving the fake commodities such as disturbing the order of market economy crime began to emerge recently,also in a growing proportion.Even so,Dongguan migrant workers crime still property crimes such as theft,robbery,fraud was more outstanding,the proportion of the biggest robbery.2.On the migrant workers crime characteristics,crime is given priority to with men,women with a slow,small proportion of sinner.O n the criminal age,young people accounted for a significant proportion.O n the criminal time,type of crime against property performance has certain seasonal: it will make a low in February,July and October,and make a peak in January and June,it will also make a small peak in August.Except for above months,the other months in crime rate maintained at a relatively stable level.O n the motive of the crime,has the following three points: first is to fulfill their material desires,with prominent economic benefits for the purpose of crime;Second is to seek relief,malicious revenge;Third,The motive of the crime belongs to the instrumental motive,the blind obedience and the profit seeking psychology are serious.3.The cause of the crime is very extensive,combined with the investigation,this paper uses the theory of data a nalysis,from the political,economic,social,technical analysis of four factors.(1)political factors,migrant workers is the main body of social transition costs borne by the group has not been formally incorporated into the city social management system;(2)economic factors,individual economic conditions of migrant workers and urban residents is weak and the gap between the rich and the poor;(3)social factors,adverse effects of cultural life,the lack of grassroots judicial the function of the organization;(4)technical factors,educated,legal knowledge,legal awareness.4.In this paper,the prevention of migrant workers crime,but also from the political,economic,social and technical aspects of the four factors.(1)political factors on the development of two yuan,break the structure of urban and rural agricultural modernization,the migrant workers into the social security system;(2)economic factors,the development of rural service industry(third industries),especially the sightseeing agriculture and sideline,improve the employment rate of migrant workers,increase their income;(3)social factors,increase and improve the construction of the culture of migrant workers,to further strengthen the construction of the judicial organization;(4)technical factors,reduce the cost of education for children of migrant workers spending,using the community to strengthen the propaganda of legal education of migrant workers.
