A Study On The Discretion Of Law-enforcement Officials During Passengers' Inspection In Shenzhen Customs

With the deepening of reform,it becomes more urgent to build a law-ruled service-oriented government,As a result,the consciousness and ability of the civil servant's administration has been improved obviously and citizens' consciousness of democracy and legality and the consciousness of safeguarding the rights according to law have been notably enhanced.At the same time,the contradiction between the two has become more and more obvious.Some events are easily seen like arbitrary enforcement and violence against the law.Most of the time,the law executives are criticized often while their counterparts who are enforced by those executives are regarded as vulnerable ones.The strong sense of work-burden faced by law executives who have been attacked by the need to be tough and strong as well as the need to be considerate and soft as civil service-workers is often neglected by the public.The research of the dilemma faced by grass-roots law executives of how to balance legality and rationality has an indispensable role to improve the abilities of law execution but also has a noticeable effect to improve the efficiency of government departments,the establishment a good law executive relations and promoting social harmony as well as stability.This thesis mainly consists of five parts.In the introduction part,it introduces the source of to the topic and the significance of studying on this topic.It also presents the related research from home and abroad.Then it also presents the research methods,research ideas and innovations of this paper based on the theoretical foundation,Chapter two mainly introduces the characteristics of the law enforcement and discretionary power during customs brigade inspection,Chapter three carefully studies the background and related details of Shenzhen Customs'"futian Port congestion" event on 2016 and Customs" e " Channel incident on 2017.Chapter four analyzes how the customs officers deal,with the complicated situation where there is conflicts between legitimacy,rationality and reasonability using their discretion by taking the background of the incident and the complicated law enforcement environment.Chapter five puts forward some suggestion on how the grassroot-level law executives administer in the context of complex law-enforcement environment under the background of constructing a government based on the rule of law and a service-oriented government.
