On The National Monitoring Power Under The Supervision System Reform

The separation of administrative supervision and discipline inspection and supervision in China has many drawbacks in practice.It is difficult to effectively exert its role in supervising public power.According to the Nineteenth Congress,the Party Central Committee has proposed a general strategy to promote the rule of law in an all-round way,in order to strengthen the exercise of all public powers.The supervision of public officials has achieved full coverage of national monitoring,conducted in-depth anti-corruption work,and deepened the reform of the national monitoring system.On the basis of combing the development of China's supervisory system after the founding of the People's Republic of China,this article combines the latest hotspots and difficulties in the reform of the supervision system and discusses the right of state supervision.This article is divided into four parts.The first part reviews the state monitoring power and the reform of the supervision system.It starts with the development of the national monitoring power and the necessity of the reform of the supervision system to introduce how to go from the administrative and disciplinary inspections to the supervision of the government.The second part is the latest from China.Starting from the reform of the national monitoring system,the “Constitutional Amendment” and“National Supervision Law” are used to carry out a normative analysis,and the specific content and procedures of the functional positioning and oversight powers of the country's supervisory powers are reviewed;the third part passes through to Sweden,Singapore and Hong Kong.The comparative study of the supervisory system summed up the beneficial experience in the reform of China's supervisory system;the fourth part is the further guarantee and implementation of the supervisory power,starting from the supporting legal system,supporting procedures,and supervision and restriction of the supervisory authority.We are committed to creating a centralized,unified,authoritative and efficient monitoring system to ensure that the country's monitoring power advances the reform on the track of the rule of law.
