Research On State Supervision Power

The supervision power is a kind of public power,it belongs to the category of social relations,social relations is the mode of existence,because of the need of survival and development,in practice gradually formed the social relations,social organization,social and individual behavior has been up for the organization of the will and action,become enforceable the organization,which is the public power,including the right of management and supervision,supervision power is an objective phenomenon of human society,is the creation of human achievements,wisdom,it has experienced the democratic supervision stage of primitive society,the class society of the democratic supervision supervision or mixed kingship stage,with the development of productive forces,national supervision the right to development of social supervision power stage.The first part is to write the basic theory of state supervision power.It mainly includes the definition and nature of the state supervision power,and then expounds the basic characteristics of China's state supervision power,and derives the status of the state supervision power in China.The second part is to write the historical evolution of our country's supervisory power.Mainly divided into three parts,the first is the exercise of the right of supervision institution of the state,throughout the history of our country,mainly including the Yushitai system and admonisher system;second is the national supervision power of ideological origins and core of democracy and rectifying officials;finally is investigated through the history of ancient supervision right of our country,find out some enlightenment and lessons for China's existing supervisory authority,has a certain significance.The third partis written on the extraterritorial supervision power supervision system and the investigation and comparison,mainly includes two parts,one is the study of foreign supervisory power,the two is the extraterritorial application of the supervision power of our country supervision enlightenment.The fourth part deals with the scientific allocation of the state's supervisory power in China.The basic principle of first to write a national supervisory authority must adhere to the scientific configuration,there are four main:1.adhere to the leadership of the party;2.adhere to the dominant position of the people and the people's Congress supervision;3.adhere to the rule of law right and control right according to law the principle of combining 4.adhere to the independent,efficient and authoritative principle.Secondly,the author wants to ensure the constitutional status of the state supervision power,and discusses from two aspects:1.the necessity of establishing the constitutional status of the state supervision power;2.the feasibility of establishing the constitutional status of the state supervision power.The constitutional status of help with the establishment of national jurisdiction,the supervision power of the constitutional status of the right to monitor,audit supervision power is consistent,beneficial to establish a supervision authority,to ensure the authority of supervisory organs of normal play.The last part of national supervision last wrote,is elaborated from four aspects:the basic ideas of 1.national monitoring system;set up the leadership mechanism of 2.national monitoring system;power allocation and operation of 3.national anti-corruption supervision system;4.state supervision institutions and the perfection of law system.
